hi everyone,

I filled i-130 for my fiance and step daughter in order for her to get a fiacee visa (K1  and K2) to come to the u.s. she  and her daughter came to the u.s in February, we got married in march. do i need to fill another i-130 concurrently with my I-485 adjustment of status for both or i only need to file i-485 since they already here in the u.s and married to me?

I-130 for a fiance...? 😕

I think you filed an I-129F, not an I-130.

 

No I-130 is needed for a somebody doing AOS from K-1/K-2 so long as the marriage happened within 90 days of entry.

 

Just follow the guide above. Note that an I-944 is also needed as well.

 

Not seeing the urgency here...? Did something happen like getting picked by ICE?

If you filed an I-130 for a fiancé, that was the wrong form. The petition for a fiancé is Form I-129F.  Did they get visas or are they visiting the US right now and can’t get back home so want to stay and adjust status? Your timeline doesn’t give a clue.

You only file 485+944+765+131.

 

Why would you need another underlying petition, if you already filed one and met the requirements by getting married within 90 days!?

You don’t need another petition (I-130). They  need to apply for AOS/EAD/AP

 

1. Adjustment of Status Form I485

  • includes form I864
  • Includes form I944
  • and lots of documents

 

2. Advance Parole Form I131 (free with AOS)

  • Includes a few documents


3. Employment Authorization Form I765 (also free with AOS; the daughter may not need that if a child)

  • Includes a few documents

You’ll have three packages that all get mailed together in one envelope. Read the instructions for each package to know what goes in it.
