CFO PDOS or GCP?

Hi! Just wanted to ask (for a colleague) what seminar is appropriate for a F2A Visa Beneficiary? (Spouse of Legal Permanent Resident) Is it PDOS or GCP? and i saw that one of the requirements was a ROM. The marriage was not reported to the PH Embassy 3 years ago when the spouses married in the United States (LPR married to J1 Visa Holder), do they need to apply for "Delayed Registration" of the ROM or is it okay to just bring the foreign Marriage Certificate and License to the CFO whenever Attending the seminar?

January 5, 2001 - Entered in San Francisco International Airport with an H4 Visa (H2b Dependant)

January 15, 2003- H4 Visa Legal Status Expired, as well as H2b Status of my mom

November 1999 to November 2004 - Validity of Fraudalent Philippine Passport used in entry.

January 20, 2015 - Got a License from DMV San Francisco (Non RealID Compliant), Federal Limits Applies

December 15, 2015 - Got Married (Wife is an LPR) 

October 13, 2016- First Child is Born (US Citizen)

November 21, 2016 - Received an iTIN 

July 2017- Wife's Naturalization Ceremony

April 5, 2020- Applied for a Philippine Passport under my real name

April 20, 2020- Submitted I-130, I-485, Fraud Waiver, Waiver, Copies of old I-94 (2001)

May 22, 2020- Received New Passport

June 8, 2020- Received NOA1

Spouses and fiancees do the GCP.  They can complete that anytime.  All others over 20 do PDOS but they must wait for the visa before they can take the seminar.

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

F2A  attend PDOS.       

 

As for ROM, it must be filed through the consulate representing the state where married.

Is that needed? Cause they do have the US Marriage License and Certificate and the priority date is already current, if so can the ROM be processed in the DFA?. The marriage happened in Reno, Nevada which consulate is in charge for that?  Another question, The CENOMAR for both spouses records No Marriage on Record cause they didn't file a ROM, will that be a issue in the US Embassy Interview?

The Spouse (Male) came through a F3 Derivative Visa in 2015, My Friend (Male) and he Married in 2017 while my friend was on a J1 Visa. The NVC letter and MNL Case No. date is January 2020 for the F2A. The spouse will be able to naturalize later this year. I'm afraid they will not qualify for ROM

DFA doesn't handle recording of documents, that is PSA.  And like stated if married in the USA you must complete ROM through the consulate representing the state where married.

ROM is not necessary for the Embassy, they would each provide a CENOMAR along with a copy of the marriage certificate.

As for CFO they do ask for a copy of the CENOMAR/CEMAR.  And being they haven't completed ROM (yet) I would, for sure, include a copy of the marriage certificate.

QUESTION:   Was the I-130 filed in the woman's married name or single name?

 

Being they have not completed ROM, I would tend to go with the passport is still in her single name.     ??

Why wouldn't they qualify to complete ROM?  One spouse being a USC has no bearing on completing ROM.   All that is needed is a letter explaining reason for late reporting of marriage  ( ... didn't realize it was necessary or something like that)

They conducted a same sex marriage, i think (I'm not sure though) that same sex marriage isn't legal in the PI yet. Anyways I'll advise him to creat his own VJ account. Thank you for the help Hank!

Regarding his passport, Yes it is on his single name. But he has an expired Nevada Driver's License (from the J1 visa) bearing the married name as well as his Restricted SSN under the married name. The petition was filed under the married name but i read somewhere that you can just provide a marriage certificate if the name of the passport isn't the same as the petition (that is what i suggested to him). He hasn't created his own VJ yet 🤔😂. Thanks for your help btw, as well to  others who commented
