Hi guys,

Hope you all and family stay safe and healthy.

 

I have a question and hopefully someone can help me out.

 

I'm on the progress of AOS (NOA1 received phase). But, I just realized: I DIDN'S SUBMIT I-131 ALONG in the package! Just I-485 and I-765.

 

How can I fix this issue? Can I send I-131 now? Will there be a filling fee?

 

Thanks for reading and any advices would be greatly appreciated.

Just send it in with a copy of the i485 receipt notice as proof is submission

Fee waived when submitting with or after the i485.  The submission notice acts as proof of this

It's free if you paid the full I-485 fee: "If you properly file Form I-485 and pay the required fees, you may file Form I-765 and Form I-131 without paying additional fees. You may file these forms together, or if you choose to file Form I-765 or Form I-131 separately, you must also submit a copy of your I-797C, Notice of Action, receipt as evidence that you filed and paid for Form I-485." https://www.uscis.gov/system/files_force/files/form/i-485instr-pc.pdf Send a photocopy of the I-485 receipt notice.

Like everyone already said. You can apply for it later, just submit it with the NOA 1 from AOS.

 

Just be aware that you might not receive a combo card. There's a chance you will receive them separate.

Hi there.
It's me again.
I already got my EAD card. At first, I was thinking I didn't need to go anywhere during Covid, just wait for the GC. But now, seems like GC would take forever to be issued, I think it would be a good idea to apply for AP before the fee increased.

 

What should I submit along with the form? As I already did the bio appointment and already had the EAD?

It'll still be free for you after that date. What matters is that you filed I-485 before 10/02/20 and full I-485 fee was paid. In your case, I-765 and/or I-131 can still be filed later without fee. Renewals and replacements will also be free in your case. See "Table 4: Filing Fee Exemptions" on Pages 161-171: https://s3.amazonaws.com/public-inspection.federalregister.gov/2020-16389.pdf

Hey there! I’m in the same boat, got my EAD (in June) and thinking about applying for an AP. It seems like it’s taking forever for them to issue a gc so I was also hoping that the AP would be a faster option but who knows... 

And yes, there is no application fee for that if you already paid for the gc and if you enclose the receipt with that.

    •    A copy of EAD
    •    a passport identity page (the one with the photo), 
    •    a copy of any document issued by USCIS showing your present legal status (I guess this might be the noa-1, and any other documents from them which are showing that the GC is in a process), 
    •    a copy of a USCIS receipt from AOS application (it shows that you already paid for it), 
    •    and any documentation with the explanation why you need to leave the US and what’s the purpose of the trip.

Thought it would be helpful for someones, so I give in an update on my case.

 

Things were pretty straight forward:

- I submitted I-131 both for my daughter and myself:

+ Forms (separated form for each). On the form, I put "TBD" for the Date of the trip; "As needed" for the purpose of the trips and select "Multi" for how many trips questions.

+ Copy of my EAD

+ Copies of NOA1 of I-485 (the one with the fee information on it)

+ Copies of our passport (photo page)

 

- After about 1 month, they sent us mails to say that they're gonna reuse our biometric info

- A couple days later, we got approved for I-131
