why I am still waiting for NOA1 for I-130?

My file was transfered to CSC by May 22(We sent to VSC end of April!). The online status said they mailed a letter out, but my hubby called them and they said they are too busy now to send out letters and ask to call them back after 30 days. Within 30 days they will do nothing for now.

I am too frastrated to wait such a long for just a NOA1 to proceed I-129......

I read some posts here, people in my situation already got their NOA1 as well.

The agent again told my hubby that it is better to attach NOA1 for I-129.

It is such a tooo busy time.....I have to wait 2 months just for NOA1, increadible.

April 28 2007 sent I-130 to NVC

May 22 2007 application transfered to CSC

July 11 2007 received NOA1, decide to apply CR1 instead of K3

Aug 14 2007 touched (not sure if it is touched before Aug 14)

Aug 21 2007 NOA2 in snail mail :)

Aug 27 2007 NVC received our case, number is assigned.

Sep 11 2007 DS3032 and AOS bill generated and mailed out

Sep 12 2007 mailed out DS3032 from Canada and hubby mailed AOS bill in US. DS3032 will arrive NVC 3 days slower than AOS bill.

Sep 18 2007 Auto msg says NVC received DS3032, didn't mention AOS bill yet.

Sep 24 2007 IV fee bill generated

Oct 8 received IV fee bill. Still waiting for 864form

Oct 13 received 864form letter. It was issued on Sep 24 at NVC. Mailed out 864 on Oct 15

NVC agent said they don't receive IV fee bill nor 864. Send out IV fee bill again end of Oct.

Nov 8 IV fee bill entered to system

Nov 12 DS230 generated. But agent still said 864 is not received yet.

Nov 20 resend out 864 again(Hubby forgot to write case number on documents last time)

Nov 27 NVC Auto message said received 864, now waiting for 230

Nov 29 230 delivered. Will arrive at NVC next day.

Dec 3 NVC received 230 and put into its system

Dec 13 NVC operator told us the case is in administrative process.

Dec 14 Called operator again, and magically the case is completed!

I'm in the same boat... USCIS customer svc and immigration officers are responding the same. Time of wait seemed to changed according to 3 different officers I spoke with so far. 1st officer went by day it was received (according to green usps delivery card was stamped at TSC)..2nd officer did too. Third officer went by receipt date at CSC (where all are being transferrd). I think their learning as they go too..AAaaaagh!!! I was reminded 3 times that they do not send out duplicates of NOA1. I asked if I could use copy of receipt letter shown on online for my case and also copy of check that has case # on it. I was advised not to because this is not correct procedures according NVC. By then I was rolling my eyes and shaking my head.. just like you. Im sorry I couldnt tell you anything differently.. but just share in your frustration. Don't give up. Don't lose heart. Don't lose faith. Its coming ... really it is. We just wish it would get here faster or at least similar to other timelines that we've viewed. Not sure exactly why their backlogged (if thats really true).. But I'm praying for us all and immigration services (and anyone or thing involved in processing this). If I hear or learn of anything.. I will post it.

Anyone receive any more info regarding receiving (April/May I-130 filers)NOA1, I hope its posted? If it is.. please direct us to it. I still get a little lost searching for info on this site. Thanks (F)

You won't receive an NOA1 for your I-130. I had to call them several times in order for them to send it to me and it took 2½ months, one week before it was approved. That is the reason why we went ahead with the CR1 visa instead of K3, which is a much better visa anyway.

If you still want to file for a K3, many people have sent their I-129F with a cover letter explaining why they didn't send a copy of the NOA1 for the I-130. You DO have to put the receipt # on the letter so they know that it was indeed filed.

But please, do not sit around and wait for the NOA1 because more than likely, you won't get it any time soon unless you hound them for it. I still haven't received my NOA2 and we were approved on 05/03.

I was in the same boat and I never received the letter to this day. The letter is the same as printing out the status on line. I had to call back the USCIS the same day they told me to call back in a week. . . the second time I called, I told them it has been 45 days. Then, they transfered me to the people who will look it up for you. I found out that they had the number for tracking 3 weeks before I called but, they kept brushing me off until the 45 day period. unfortunately, I was at 40 days anyway!! I should have called them 2 weeks before. . . as we all know, every minute counts in our situation.

Once I got the number, I could look it up, print out the status page and send in my I-129F. I don't think the CSC will ever send mail due to the backlog they have now. I got mail quickly from the other centers. Why would they forward all our forms to California if they are so busy?!

What a mess??? We are in the same boat. Some worse than others. The USCIS tells us not send the I-129 w/out a formal NOA1 for the I-130. The instructions on the I-129F indicate evidence is needed but is silent on the NOA1. USCIS site says you need NOA1.

So here a question: what is the worst that could happen if you send an explanation letter with the I-129F and attach your a print out from the site?

you get a RFE :thumbs: but seriously... you should wait for the NOA1 (just a week or two more), and you have a better peace of mind..

As you can see from my profile, I sent the I-130 in 4/13, and received the NOA1 on 5/29.. but the website officially said they received it 4/27.. (so usually about a month after for I-130).. and for I-129F, I sent it in 6/4, and received it 6/14 in mail, but official date was 6/11 (so only 7 days for NOA1 here).. My estimate for you would probably be last week of June , first week of July... somewhere around there..

For us, it says a notice has been mailed on 6/9

Found the USCIS link were it says you need NOA1

the two bolded dates I have below are from the USCIS website ("we have received on..., case pending")... but the NOA1 dates I have below are "paper received" in the mail.. Also, my I-130 NOA1 didn't have a "received date" or a "notice date".. but the other information was there.. name, address, filing for spouse... but the I-129F had the notice date and received date on there.. so the I-129F NOA1 was complete, while the I-130 NOA1 was not..

Also, I made my forums signature a little easier to read.. got rid of the extra information (* No delivery confirmation yet *)

If I were you, I wouldn't wait any longer as long as I have a case number for I-130 that can be pulled through the USCIS case status site. Check my timeline - I have never received the NOA1 for I-130 and if I was waiting, I'd still be waiting to file I-129F.

There are so many people who have not received their NOA1 so it's a very common problem.

I was in the same boat and I never received the letter to this day. The letter is the same as printing out the status on line. I had to call back the USCIS the same day they told me to call back in a week. . . the second time I called, I told them it has been 45 days. Then, they transfered me to the people who will look it up for you. I found out that they had the number for tracking 3 weeks before I called but, they kept brushing me off until the 45 day period. unfortunately, I was at 40 days anyway!! I should have called them 2 weeks before. . . as we all know, every minute counts in our situation.

Once I got the number, I could look it up, print out the status page and send in my I-129F. I don't think the CSC will ever send mail due to the backlog they have now. I got mail quickly from the other centers. Why would they forward all our forms to California if they are so busy?!

This is the first post i see where lawyer advises applicant to proceed with filing the I-129F without the NOA1 from the I-130. I would be interested to learn more about lawyer's prior experience and the risks associated with this method.

A little update:

My hubby called USCIS yesterday and they simply press a buttom to request NOA1 to send out. The officer said it will arrive within a week. So hopefully, we can receive the letter soon.

If I-130 get speed up and get approved before I-129, I would probably go with immigration visa instead of K3. I can see that many people get approved around 3-4 months......

It seems keep calling is not wasting of effort.

Since there are so many people's I-130 have been transfered to CSC, I wonder how long it would take CSC to proceed I-130 for May applicants. Everything is slower down in the summer......

April 28 2007 sent I-130 to NVC

May 22 2007 application transfered to CSC

July 11 2007 received NOA1, decide to apply CR1 instead of K3

Aug 14 2007 touched (not sure if it is touched before Aug 14)

Aug 21 2007 NOA2 in snail mail :)

Aug 27 2007 NVC received our case, number is assigned.

Sep 11 2007 DS3032 and AOS bill generated and mailed out

Sep 12 2007 mailed out DS3032 from Canada and hubby mailed AOS bill in US. DS3032 will arrive NVC 3 days slower than AOS bill.

Sep 18 2007 Auto msg says NVC received DS3032, didn't mention AOS bill yet.

Sep 24 2007 IV fee bill generated

Oct 8 received IV fee bill. Still waiting for 864form

Oct 13 received 864form letter. It was issued on Sep 24 at NVC. Mailed out 864 on Oct 15

NVC agent said they don't receive IV fee bill nor 864. Send out IV fee bill again end of Oct.

Nov 8 IV fee bill entered to system

Nov 12 DS230 generated. But agent still said 864 is not received yet.

Nov 20 resend out 864 again(Hubby forgot to write case number on documents last time)

Nov 27 NVC Auto message said received 864, now waiting for 230

Nov 29 230 delivered. Will arrive at NVC next day.

Dec 3 NVC received 230 and put into its system

Dec 13 NVC operator told us the case is in administrative process.

Dec 14 Called operator again, and magically the case is completed!

I am/was in the same boat. I never received the NOA1 for the I 130. I used the status report and a copy of the cashed check as "evidence" of filing the I 130. I filed the I 129f with this evidence, and received the NOA1 for the I-129 within a week.
