Waiting for birth of child for filing ROC

Hello All, 

 

I am back to this forum after 2 years of burying my head into the sand like an Ostrich 👀 because i did not want to deal with the stress of thinking about USCIS after getting Conditional GC in 2018, even if it was avoiding for just for 2 years. These couple of years have flown by and the time has come to start the ROC journey 

 

The earliest I can apply for ROC is 15 June 2020 and the good news is that we are expecting our first child by June end or July first week.

 

Initially i decided that I would just apply nevertheless and just attach baby ultrasounds etc, and at the time of N400 send the birth certificate, but after reading the forum the general idea i got was Birth certificate of child 👼🏼 seems to be one of the strongest  💪🏼 documents in the ROC package to show genuineness of the relationship 

 

So the question is this, do I wait because its worth it or do i just apply first day of ROC eligibility date because every day counts with USCIS 😵

 

Would love if you guys and gals can chime in with what you think is the best way.

I would not wait for the birth of a child to file. I would file once I feel comfortable that I had a well presented packet.

That said, there is no need to file right at the 90 day mark...I also would not rush to file immediately at the start of the 90 days. You're talking the matter of a few weeks on a process that typically takes over 1-1.5 years right now.

 

Then again, I also disagree with the assessment that a child is strong evidence of a bona fide marriage. Scammers have had children just fine, left children just fine, etc. Things like sharing your lives together, living together, sharing bills, being responsible for each other, etc., speak more to a relationship than a child.

I’d do it before the child is born and couple of days after your ROC period opens. 

In the new mom daze (plus exhaustion and sleeplessness) you will forget a number of things and ROC is not one of them you want to forget. 

 

You can get the bc ready in case you get a RFE (or get it ready for child’s passport) - normally takes several weeks depending on your State/County unless you expedite in the hospital.

Agreed with the others. Get on it as soon as possible. Also if you file online you can go back in and add additional documents. It does say they are not obligated to look at them but they are there. Get in line is my best advice. I've been waiting since 2018 for movement on my ROC. And after a new baby you definitely don't want to be bothered with dealing with USCIS paperwork if you buried your head for two years. 🙂

File now.  With all that has been going on - everyone should have learned by now to get things done as soon as possible.

You can't file an I-751 online. It's paper-only.

Ugh yes sorry. Mixing it up with the n400! Too many forms. So yes, scrap that part!!

just to clarify I do have almost all documents ready, if I wait it would ONLY be for the birth certificate. Like somebody pointed out, Birth certificate might also take some time so I think it’s wise to just send the package. plus considering how long ROC is taking these days my N400 1 year later can have the birth certificate. 
 

I guess I would send the package in mail on 15 June (89th day) because technically ROC window starts on 14 June Sunday (90th day) and it would reach them by 80 something days from CGC expiry.
