Hello,

 

I am a US citizen and my Fiancé is in Nigeria. The USCIS sent their approval and forwarded the approval to NVC. I have not received an email or mail from NVC since the application has been approved by USCIS April 24th. 

I called the NVC to check if they emailed or mailed me something and was told they have not but I was provided my case# and invoice #

 

So here is where I am confused: When I checked for the status online on CEAC website, i received this message once I entered the case # and invoice #

K visas are nonimmigrant visas that assist spouses or future spouses of American citizens in entering the United States. As with all nonimmigrant visa applicants, a DS-160 must be filled out in order for a consular section to process the case

What is this for?

 

When I enter the case number it is listed under immigrant status then this message - so confusing. Help! 

 

Please guide me on this process.

The K-1 visa is a nonimmigrant visa that allows dual intent. That is why your fiance will submit the Online Nonimmigrant Visa Application (DS-160). But the Immigrant Visa (IV) unit of the consulate will do most of the visa processing (interview, etc.).

K visas are non-immigrant visas, hence why you submit the DS-160 (non-immigrant visa application) to apply for one.

They are handled by the immigrant visa unit at the consulate because they have very similar requirements to that of an immigrant visa. They are best equipped to handle cases that require police certificates, medicals, an affidavit of support, evaluating a relationship, etc.

What is this for?  The DS-160, Online Nonimmigrant Visa Application is a required document to be used by the CO to evaluate the beneficiary's circumstance along with a few questions about the petitioner. It is not optional to complete as each embassy requires it for the interview. More details can be found in the links below.

As a K1, when checking your case online at CEAC.state.gov you have to select "immigrant visa" as it is treated like as such even though it is a "non-immigrant visa".

 

Technically the K-1 is a non-immigrant visa but it is treated like an immigrant visa because of the AOS. It is kind of a ba$tard. Non-immigrant treated like an immigrant. Other non-immigrant visas do not usually end up with green cards!  The K-1 on its own is a single entry, short time limit visa that expires 90 days after POE. You are a non-immigrant (90 days limit) with immigrant intentions (GC). That is why it is a non-immigrant visa treated like an immigrant visa.

 

You have three stages 1) transit - shipment is in the air or soon will be, 2) received - physical case file is at the Embassy and 3) ready - your case is ready to schedule and complete your interview.  These will be your current state or status to your case file once you have received the case number.

Scheduling the interview can take 1 to 3 months. Once you pay the $265 visa fee at GTB Bank, you can go online to schedule an appointment at www.ustraveldocs.com You can get the forms online at http://nigeria.usembassy.gov/immigrant_visa_forms.html No need to go to the consulate to pick up forms. Download forms if unexpired or get current versions of same forms. Email LagosIV@state.gov for your interview date.

The I-129F is a petition to sponsor an foreign national spouse.  Once it is approved, then your spouse can fill out DS-160 - non immigrant visa application.  Your fiance fills it out, but you can assist.
