Hello everyone.

I am coming here to ask for your experience and for your advise with regards to my case.

 

My mom petitioned me and my siblings on March 2012. My mom became a Naturalized US Citizen on September 2018. Did our category automatically changed? We did not receive any notice about it getting changed. Also, I was able to come here in the US through my job. How do I process my papers? Do I need to go back to the Philippines or I can just do an adjustment of status here in the US? If so, how will I do it?

No, she did not. We thought, they will know it already. But should we inform them? If so, how and whom should we contact? The F1 category seems faster right now compared to f2b for Philippines...

Hi,

 

When your mother became a US citizen, your category automatically changed.   Your mother did not notices that it changed, presumably because she never informed USCIS or the NVC that was handling the cases that she became a US citizen.  

Whether you can AOS depends on whether you can legally in the US when your PD becomes current.  Your PD is not current.  You need to look at the Visa Bulletin.  Once your PD becomes current in Table B, you can file for AOS.  However, getting a green card depends on your PD becoming current in Table A.

You have to inform the office that is handling the cases that your mother became a US citizen in order for them to know.  The burden is on you to provide information, not for them to go check.  


Google "contact NVC to inform petitioner became a US citizen."

I see. Thank you, Aaron2020.

Should we contact USCIS or NVC? By phone or email? Our petition had been approved at USCIS last Sept. 2013... does this mean that our files/cases are at NVC and that they are the one we need to inform? So if I am still here in the US through my work (L1 visa) and my priority becomes current then I will just do the adjustment of status? Sorry for the too many questions. Thank you so much again.

You must submit proof of citizenship to the National Visa Center (NVC) so they can update your family member’s visa category. Scan and save one of the below items as a PDF or JPG file. Then send it as an attachment to Public Inquiry Form:

  • A copy of the biodata page of your U.S. passport; or
  • A copy of your certificate of naturalization.
