Hello,

 

I am a naturalized citizen and am petitioning for my 65 y.o. mother. She initially came to visit only and her flight was to leave a few days after all the shutdowns started happening and her flight consequently cancelled. We have been waiting for the borders to open but when we learned that it wont happen until beginning of july ( her country of residence), we started to look at out options. Filing for adjustment or visa extension. We decided on AOS for family reasons. Because of the unpanned decision and the new form I have so many questions but will try to contain only the ones pertaining to I - 944. 

 

Part 2. Household @Villanelle had a great answer here

and it was also how I read the question. In her ( my mother's) household she is the only member - for now. 

 

Part 3.   1. A   Do I check *Not requeired or * Other? She never lived here to pay taxes. Back home she pays taxes on rental income and property taxes only since she is retired bus she does FILE taxes. Different system there. Do I explain?

 

               6. C  She has rental income from a few properties. Do I list each or an annual sum from all?   

            

               9.  We were able to get some of the documents for her properties but not all. For the ones we got, will it be a problem that some are a couple of years old? She didnt plan to come, otherwise she would have updated ones and no way in getting anything recent since she is here.

               To support her rental income I have Translated all of the rental contracts and have Bank statements ( to still translate) as supporting documents. She also receives pension.  

               BANK STATEMENTS = Is it ok to highlight the transactions that correspond to the rental and pension? 

             

              15. Health Insurance.  I read many posts on the topic and still unsure if enrolling in Healthcare.gov but not in subsidies is considered a public charge. Any advice on Insurance? 

               If i mark, I will soon enroll, what kind of evidence do i need to provide for that?

For health insurance use healthcare.gov she just can’t get Medicaid or Medicare. You will be paying a hefty amount and I think you can sign her up today. If you chose not to (or unable) you can print out an option you intend to purchase. There is a limited time frame to sign up for insurance so make sure you are in it otherwise she can’t enroll until open enrollment and will greatly hurt her chances of immigrating. 
 

Will your mother continue to receive her pension while being a permanent resident of the US? You need to look into that.

 

the income documents that are years old for your mothers property are completely moot. They need to show current income- no one cares what she made 5 years ago. she has no one in her home country that can scan her these documents? How does she plan on continuing collecting rent? 
 

good job translating the documents. Make sure you include the statement with your name and that you are fluent in whatever language.


she has not been required to file taxes up until she becomes a LPR so not required.

 

If she becomes a permanent resident of the US she will be required to report worldwide income just a FYI if you weren’t aware.

the income documents that are years old for your mothers property are completely moot. ( They are somehow in context with her Bank Statement which show several monthly rental deposits. I have contracts for those rentals and what are old are the property documents but they support her rental on those properties.- I hope that makes sense. I probably should write a cover letter with some sort of explanation)   They need to show current income- no one cares what she made 5 years ago. she has no one in her home country that can scan her these documents?  How does she plan on continuing collecting rent?

For calendar year 2020 she'll be a resident alien for tax purposes regardless because she'll be physically present for more than 183 days: https://www.irs.gov/individuals/international-taxpayers/substantial-presence-test In early 2021, IRS will publish the 2020 Filing Requirements Chart. If her worldwide gross income is lower than the listed threshold then she won't be required to submit a tax return for tax year 2020.
