Hey guys! My grandma is going to be my cosponsor and she is married with my grandpa. they file their taxes together and are both retired. Can she just submit her information on the I-134 and provide a copy of the jointly filed tax return? Since they're both retired she has no paystubs or letter of employment.Thanks in advance!

My husband is self employed so he doesn’t have either of those and that’s all I did. I submitted 3 years of tax transcripts. It says you can submit a return but I got an RFE for an IRS transcript when I applied for AOS. It’s easy enough to print them off the IRS website. Worked for me.

Thanks for the response! I'm just wondering if she is able to put their shared income onto the I-134. :)

I believe so because they filed Married Filing Jointly, correct? If they filed taxes separately then she would have to just put her own income. Someone correct me if I’m wrong.

I can't find a solid answer anywhere on the net or with the vj search function. I'm not sure what to tell her to fill out. My grandma will be acting as my Co sponsor for the I-134 affidavit of support and she files taxes jointly with her husband and they're both retired. Does she submit their joint tax return and include both of their income on her form? Would he need to fill out an I-134 also?

I'm reading the instructions from the checklist, and it dows clearly say but my interuptation is that everything your Grandma submits is going to be joint custody of the accounts so naturally your Grandfather will be a part of the I-134, Affidavit of Support by default. Put her down on the I-134, Affidavit of Support and he will "tag" along because he is a part of the financial accounts. Try and not over read into the process as it can cause you to be confused. Think through it logically and I believe you will have a better outcome.

Did you submit the following? 

  • A signed statement from an officer of the bank or other financial institution that states when you opened an account, the total amount deposited for the past year, and the present balance of such account
  • A signed statement from your employer on business letterhead that states the date and nature of your employment, salary paid, and whether the position is temporary or permanent
  • A copy of your last income federal tax return filed, or a report of commercial rating concern (if self-employed)
  • A list containing the serial numbers and denominations of bonds and names of the owners (if applicable)
