I use the "Case tracker for USCIS" app on iOS so I get notifications anytime there is a status check for both my I-751 and N400 cases.

So sorry to hear this. We also filed our case 1 day early to the 90 day period . But they send back the package within 15 days and told us to refile.

 

I think in your case it’s better to refile again with a cover letter  explaining your situation and request for an expedite( only if you didn’t get the package back). I don’t know if they expedite, but they are also responsible for the delay.

I encourage everyone to double and triple check their exact eligibility date to file and wait few days to mail it or file online.   Filing Few days later is much better than refiling and losing your application fee.

I agree with you . But they didn’t cash our check . Only loose FedEx overnight shipping charge and wasted 3 weeks. I think we will loose our application fee once they accept the application and assign a receipt number.

Hello everyone!

 

I had my combo interview on Friday at the Milwaukee FO. I was only scheduled for the N-400 interview but my husband went with me and the officer thankfully decided to do the I-751 interview at the same time since she had the file. All went well, the officer was super nice and professional.

 

She asked for our IDs and then she went through the basics of the application (names, DOBs, addresses, etc.). She then asked my husband and I a few questions:

  • How did we meet?
  • Where did we get married?
  • How long did we do long distance for?
  • What is in our future as a couple?

She also asked if we had new documents that we wanted to submit so we gave her our lease renewal, updated insurance and more recent utility bills. She then escorted my husband back to the waiting room so we could do the N-400 interview. 

 

Since my N-400 application was recommended for approval, the officer said that I would not receive the 10-year green card and will just get the oath ceremony letter in the next month. I am now just waiting for the formal approvals for both applications and online status changes!

hi everyone, im just curious if there is anyone here with I751 with a divorce waiver AND filed n400(citizenship) with 5 year rule. 

is it true that you cannot file/apply n400 if your i751 is waiver? (divorce is finalized)

 

I have a pending i751 with waiver(pending over 18months) and i filen n400 11 months ago.

If you have had your green card for 5 years minus 90 days or more you can file an n400, even with a pending i751 waiver or not.

thank you for reply. that is what i thought too. here is my situation can you respond?

 

i had my conditional green card and applied for i751(without waiver) then my i751 got denied because of divorce. when my divorce was finalized, i submitted a new i751 with waiver and it is pending today.(i751 with divorce waver)

 

when i reach 5years after my first day of conditional residency(temporary green card) i submitted n400 and it is pending now too.

 

so in short, my first i751 got denied because of divorce then i filed second i751 with waiver. after 5 years of initial green card, i filed n400 while i751(divorce waiver) is pending.

So yes you can apply for the n400 but the n400 can not be approved until the i751 waiver case is approved first.

 

You may get a combo interview at your local field office for both cases. You will need to be ready to prove that your marriage was entered into in good faith and then pass the naturalization test and show you have good moral character (tax paid, no legal issues). 

 

If you get an n400 interview first with the i751 still pending without approval that will hold up your naturalization case.

thanks again.. i totally understand and know that n400 cant be approved without i751 but i think it is true for every n400 with i751 situation. i'm just waiting for interview for one of them or ideally both(combo)

 

i was just scared to hear someone says "you cannot apply n400 if your i751 is divorce waiver". i guess i was just scared for nothing. i hope so..
