Is there a deadline to send documents to the NVC?

Timeline

Hello. So my wife is applying for a spousal visa. We went through the initial steps and our case was sent to the NVC in October of 2019 so we are now at the point where we have to submit info through the CEAC website. If we wait too long will her case expire or could we theoretically take even two years without any repercussions? Thanks for any answers :)

1 year from case creation by NVC 

AOS Journey

  • I-485 etc filed 23 April 2020 
  • NOA1 I-485 June 3 2020 
  • NOA1 EAD 23 April 2020
  • Biometrics 5 Jan 2021
  • EAD approved 12 March 2021
  • Interview Completed 24 March 2021
  • EAD Card Received 1 April 2021  
  • Case under review 2 April 2021
  • New Card is Being Produced 25 September 2021
  • 10 Year Green Card Approved and Mailed 27 September 2021 🙌🙌🙌🙌🙌

As long as you contact them once a year (call or message)  you are good for as long as you wan to.

In theory that's correct.

 

However, how do you prove later on that you logged in or called? The burden of proof is always on the applicant, so you run the risk down the road that you get termination.

 

The safest bet would be to submit either AoS or IV application when 1 year approaches, then stall submition of the rest. Keep submiting later on to extend the time as needed. Also keep in mind, that once all docs are DQed and interview date is set, you can also reschedule it for later date directly with embassy post.

NVC does not "approve" applications, it just pre process for completness so that uncomplete petitions don't get forwarded to consular posts.

 

the safest way to stall adjudication would be to submit ALL req documents to NVC before 1 year mark passes, then wait untill they DQ and forward it to embassy and if needed then stall interview date a bit more by working with consular post (but no later than a year from submition of all documents to NVC).
