It’s not an issue if no conviction usually...you’ll need to make sure you disclose the info to them, they’ll want copies of any court records & fine payments (if any) to prove it’s not outstanding

Depends on the offence too? 
 

Someone on here from Australia didn’t have anything on their police recorded but was arrested for drugs offence as as that’s a crime in the US, they needed a waiver.

14 October 2019: Sent I-130 package via AusPost 📮 

18 October 2019: NOA1 received - sent to Texas Service Centre :D

24 October 2019: USCIS processed filing fee 🤑 waiting game 🕰️

22 January 2020: Andy moved back to the USA😞 🇺🇸 - re-establish domicile & to get a job 👨‍⚕️

23 February 2020: Petition transferred from Texas Service Centre to Nebraska Service Centre 😞

15 May 2020: I-130 petition approved! 😭😍 Date changes leading up to the approval were: 1 May, 12 May, 13 May. 

16 May 2020: Received NVC email, paid all fees. Waiting for fees to process so we can upload and submit all documents

19 May 2020: Immigrant visa Fees PROCESSED; affidavit of support fee PROCESSED 

28 May 2020: Submitted VISA application, civil documents & affidavit of support documents. Patiently awaiting DQ. 

2 June 2020: Email received from NVC stating that we have been Documentary Qualified and that they will liaise with US Consulate in Sydney for Interview 🐨

27 June 2020: Expedite request submitted 🤞

7 July 2020: Expedite request APPROVED! 😃😭

15 July 2020: Email received advising of interview date and time. 
20 July 2020: Medical i: n Melbourne CBD 🏥     
28 July 2020: US visa interview at US consulate Sydney - refused 221(g) issued. Request for joint sponsor 😞

31 July 2020: uploaded joint sponsor to NVC, emailed consulate 

5 August 2020: emailed received advising they have received the joint sponsor 

7 August 2020: case i0n “administrative processing” 🤞

10 August 2020: visa ISSUED 😭 

12 August 2020: passport and visa in hand!

you do need to make sure you go to the right doctors/dentists etc if you don’t go to one of their designated doctors they charge you massive out of pockets.. not like home where you can go to any old GP... that’s also why I think there’s some cheap policies out there... cheap insurance but drive an hour to find the doctor.. so check they have doctors in your area too

Oh interesting. I wonder if our income factors in because my partner is still studying so we are both living on my income of about 50k USD. Our coverage came to about $285 per month. We both are under 35. Luckily the pre-existing condition thing isn’t a factor right now thanks to Obama or it would be very different. I’ll have to be careful with which doctors I see then. It’s going to be interesting getting used to all this...

Hi All,

 

I received an interview for next week at the U.S. consulate in Sydney but I'm in Melbourne so I have to decline it and wait for the borders to open up. Does anyone know anyway around this by getting into NSW without having to do the 14 day quarantine? I'm hoping I can reschedule it soon as I'm due to give birth in November.

Pre-existing shouldn’t be an issue, Trump signed an executive order to ensure prior conditions remain covered under his plan, it should become cheaper if anything..  it’s likely earnings, age and type of cover.. our combined income is pretty good, and being in our late 40’s we’ve have to have top coverage with full dental.. Unfortunately the closer to 50 you get, the more you tend to fall apart 😂
 

I still find it expensive, guess I always will when comparing it to health care prices back home though..

yep totally agree with you there! Hopefully once my partner graduates he will have a good medical plan through his job that covers me and is reasonably priced or free.

It was definitely nothing like that! just a small petty first time offence! Lawyer is trying to charge me wayyyyyy too much money for the waiver.

Did the lawyer say you’ll 100% need a waiver?

The consular officer will determine if you need a waiver or not.. not the lawyer. If you go submit a waiver application without being in AP will take 12 months to process looking at case processing times.. let the CO advise if one is needed, that way they review it as part of AP which is way faster.. 

 

Don’t forget, it really depends on the charges, like I said, disclose it, take all the court records and evidence that applicable fines were paid off with you to the interview.. depending on what it is and when it occurred they may not actually care..
 

the only time you need a waiver is if it’s an inadmissible offence.. e.g. multiple dui, drug offences, violent crime.. etc Is the issue you have listed as an inadmissible crime? If not, don’t worry about it

The lawyer said we should prepare one just in case. So maybe I will just pay the money just to have it in case but I won’t submit it unless asked for it.

a waiver is something approved by USCIS I believe and must be submitted to USCIS for approval. Those outside the US take around 4-5 months to be approved. So I’d have it approved before the interview if it’s likely you’ll need one... just incase. Or as Advised, just wait for consulate.

Inadmissible crimes are outlined in the attached link.. you said it was a petty crime with no convictions...  so realistically speaking you shouldn’t need to waste money on a waiver application and lawyer fees.. 

 

you either did, or didn’t do one of the 11 things listed, it’s pretty straight forward.. assuming your not a prostitute, Drug or human trafficker, money launderer or against religious freedom. it really only leaves 2 options.. If it’s neither of those, no need to freak out

Wanted to give an update - hubby is in the US!!

 

Interview Tuesday, Sept 29: approved

Applied for travel exemption, approved (he used the email saying he had an interview)

Visa issued: Wednesday, Sept 30 

Received in mail: Thursday, Oct 1

Flew out of Sydney Saturday, Oct 3

 

Only 30 people on his entire plane. 

 

Landed at LAX, only took 20 min to get through customs and get baggage. The only thing they checked at customs was if the address he told them matched the address on the application.
