Unfortunately, then you are in the same boat as others. I-944 was a disaster, with loads of ambiguities in needed evidences. Hope we all survive it without RFEs

Please help
AOS stages after K1 marriage. I just got my second RIFE stated that my income and household member's income not meet the 125% requirement and I need new joint sponsor or send in other docs for final decision. Please help me explain if I did things wrong.

Here is when I filed my case
- I-The petitioner was a student and did not make much for the last 3 years, around 15k and I lives in the same household as the household member (father).
- We all share the same address, a household of 5 people including me, my spouse(immigrant), my dad, my mom and my brother.
- I filled out I-864 for myself as a petitioner sponsor for my spouse. Since I did not make enough, I claimed my dad as the household member. He made around 31k for the last three years.

- I submitted my tax return for 2019,2018,2017 and my dad's tax return for the following years. On my dad's tax return, my mom also was on there because they file tax together and my brother was on tax as dependent.

- I also submit my almost last 6 months paystubs which I currently making almost 40k/year, and my dad making 35k/year. I entered the household size as 4 on I-864

I dont know why it still not meet the income. I looked at at the requirement, we need only around 38k to be good to go, but when I combined my income with my dad's income, it is over 40k already. Now I have to resubmit all paperwork soon. Please tell me if this is good enough

_I will submit new i-864 and change the household size to 5 including 2 household member's income are my dad and my mom (file 2 I-864A)

_I will submit my 6 months current paystubs, hired letter where it present my pay rate and estimate my annual income, my 3 years federal tax income including 1040 and W2, bank statement for last 12 months, current balance and FICO score. I will submit the same for my parents. 

Does it good enough or do I have to do I-864 for me, I-864 for my dad and I-864A for my mom? Then would it be the household size will be different then?
Please help me because I'm worrying that if the case denied then I dont even know what will happen with my spouse.

Thanks for the encouragement. *Pretty* different timeline though...our I-130 was approved in Oct 2019. We were DQ at NVC and waiting for a consular interview to be scheduled when we decided to apply for AOS

March 2019: Married, Filed I-130 in April 2019

AOS: Filed June 10, 2020, Received June 13, 2020, Cheque cashed July 16

(I-130 approved in Oct 2019 because we were originally doing consular CR-1 processing)
NOAs July 24 (dated July 17) 2020
Biometrics Jan 7, 2021 (notice dated Dec 12, received Dec 22)
Case updated to 'Interview Scheduled' (Jan 19, 2021, received letter Jan 25)

February 24! Interview! New Card being produced!

Feb 25, 2021: Case approved.

March 1, 2021: Card was mailed

March 4, 2021: Green Card Received! 🥳

March 25, 2021: SSN Application
March 29, 2021: Received SSN
Dec 5, 2022: I-751 ROC Delivered to Lockbox

Absolutely NOTHING was wrong with the packet we sent...and yet the only remedy is to re file.  That means back to the end of the line. Months lost and for what....

 

There is nothing preventing them from doing the same thing again.  Over and over...

 

Worst thing is...there is absolutely nothing you can do about it.

 

Refile and let them reject us again?  How many times?

 

 

SO FRUSTRATING!!! I went through the SAME. Sent in for the FOURTH TIME now. I was told by the tier 2 agent that my submission should not have been rejected and the only remedy was to refile.

It seems the beginning of virtually every process I've taken with USCIS has had some problem. The original petition for my wife took weeks and weeks beyond the expected turn around time. I'm hoping for a similar situation now for my step-son's AOS on a K2 follow to join.

 

June 13, 2020 - Mailed I-485 packet* along with I-131 and I-765

June 16, 2020 - USPS confirms packet delivered

 

 

So far no other updates. I paid by check and have not seen it hit my bank. I've seen most people here have experienced 15-25 day waits. Today is day 44... I finally gave in and called USCIS and the woman I spoke to was just lovely, She told me "You're not the only one filing paperwork", "Well you'll just have to keep waiting because you don't have a receipt number". Getting her to escalate to tier 2 was like pulling hens teeth. I'm scheduled for a call back in 761 hours!

 

Anyone else having an excessive delay? This is at the Chicago Lock Box...

our timeline with the RFIE is similar to yours. They requested a birth certificate listing my husband’s parents’ names. We sent one by USPS certified mail 7/20 to the NBC in Lee’s Summit MO but it is still “delayed” as of today 7/30 so we sent it again today overnight express. Fingers crossed this one is received before the furlough begins.

Almost exact same timeline here. DQ'd, then decided to adjust status and that was received on Canada Day (July 1 2020).

I had 47 days wait from package delivery to USCIS. calls to USCIS and speaking to a tier/level 2 prove futile. They all told me to be patient, i did because there is no going around that. Wait a few more days you will hear something soon.

Hi

Im new to the platform and currently at the stage of submitting an AOS for I-130 petition for F-3 category.

Can any expert here give me any leads about  if a petitioner sponsor is retired and residing in adult married child’s residence permanently, can that child be added as either the one who join his income with petitioner (since petitioner lives in the same residence as the him) or a joint sponsor? Is there any preference in eyes of immigration law to add a household member’s income to meet the requirement or adding a joint Sponsor ? Would going for any can affect the decision?
 

 any lead in that is highly appreciated . Thanks.
