Got the RFE (RFIE?) in the mail requesting my husband’s birth certificate with his parents’ names listed. I’m guessing this is the long form. 
 

The letter states it must be returned in 87 days, but this COVID update allows 60 additional days. 
 

Do they mean BUSINESS days or CALENDAR days? 87+60=147 days to return the RFE

USCIS will consider a response received within 60 calendar days after the due date set forth in the following requests or notices before taking any action, if the request or notice was issued by USCIS between March 1 and Sept. 11, 2020:

  • Continuation to Request Evidence (N-14);
  • Notice of Intent to Deny;
  • Notice of Intent to Revoke;
  • Notice of Intent to Rescind; and
  • Notice of Intent to Terminate.

In addition, USCIS will consider a Form I-290B, Notice of Appeal or Motion, or a Form N-336, Request for a Hearing on a Decision in Naturalization Proceedings (Under Section 336 of the INA), if filed 60 calendar days from the issuance of a decision by USCIS, if such decision was issued between March 1 and Sept. 11, 2020, inclusive. No EAD, I applied for the social security number under the immigrant not authorized to work category. I sent in my passport with my K-1 visa and admission stamp, a copy of my online I-94 admission certification, my marriage certificate and even a copy of the page on the social security administration website which specifies that K-1 visa holders are eligible for a social security number.

 

They sent me a letter a couple of weeks later saying they sent my case to DOS to verify my alien status and it might take an extra 4 weeks. Almost 7 weeks later I called the social security office because I still hadn't heard anything and they told me my case was still at DOS waiting to be verified but my I-94 had just expired so I wasn't eligible for a social security number anymore. I was pretty annoyed as I had sent them everything they needed to verify my legal alien status without them having to send it for verification but they still sent it and now it had taken so long my I-94 expired.

 

It is also the reason I took so long to send my AOS application because I was waiting to have my social security number so I could have health insurance and stuff for my declaration of self-sufficiency 🙄 so now I'm in a situation where I have no proof of legal status because my NOA from the AOS is taking so long

Congratulations to all that are lucky enough to have some progress...

 

Still baffles me how hit or miss this process is...totally unfair and unorganized.

 

I see one after another case that was received at the lockbox after ours being charged for the fees and letters received.

 

Really sick and tired of the inconsistencies.

don't sweat it, it will only make you stressed. I am waiting for my 30 days next week to contact them.

I have the same issue. I don’t see an active thread for employment based AOS for June filers. 

My info as follows...I got my I-140 approved on 6/10/20 and mailed my I-485 on 6/17/20 (received by Dallas lockbox on 6/19/20). Still I did not receive my confirmation texts nor my checks were cashed. Looks like people filling in Dallas are experiencing a long delays. Hope to hear something positive soon!

Well better get used to it because immigrations is full of inconsistency! Some self inflicted some not!

Citizenship Complete!

Can the inconsistencies are based on the lockbox location? I see some lockboxes like Dallas responds very late

Yes IMO it's  USCIS and government wide lock box and all!

Yes , it took exactly 30 days for me to receive a text message with my case number (I still haven't received the actual mail)..

Unfortunately today we received our ENTIRE PACKET back in the mail.  We really need some help understanding what they are asking for.  For some background, Our AOS packet was for my wife and  11 year old daughter.    We did everything right.  We were married well within the 90 days.  I filed complete AOS packets for them both...485/944/864/765/131 for each of them.  The 797 attached to my wife's 485 stated "one or more of the applications in the package you submitted was unacceptable for the reason specified on the related notice".

 

I have attached that Notice below.  This is the 797 was attached to the child's I485.

 

Please, someone explain to me how a priority date applies to a K2 minor child?

 

How do we proceed?

 

I called USCIS already this morning after receiving the packet back and the woman I spoke with was not able to help and said I should call back another time and try to get connected to a higher level agent.  She claimed she was unable to connect me today due to high call volume.

 

I am at my wits end....any advice would be greatly appreciated.

So sorry to hear this. i note 3 things- Did you send a copy of K1 NOA with priorty date?  Did you state priority date on form? and did you complete Part 2 on form I864 and I944? look back on all those documents. i pray you resolve this soon.
