7/22/2023: Both (parents) petitions approved

7/27/2023: Both cases sent to NVC

8/8/2023: Received NVC welcome email for both parents

Just wanted to update. I attended the second interview and the same "decision cannot be made". The explanation was due to extensive travel, none over 6 months and an arrest which was thrown out. My understanding is that even if your travel appears close to half the specified time, it's an issue. He made a big deal about it. I got the proverbial "action has been taken on your case" email 2 days later but up till now, 5 weeks later, nothing. I'm starting to worry but nothing I can do at this point but wait.

As of today, it has officially been denied, their justification, a break in continuous presence. How long do I have to wait to reapply?

Thanks for your response, appreciate the feedback. I heard about the appeal through this forum but not much info so was wondering if it would be a waste of money and to just reapply instead?

I think you should appeal after considering with an immigration attorney. If you reply now, the question break in continues presence might arise again.

So were you out of the USA for more than 180 days in any one trip? If so then you will need to wait 5 years from the latest trip that went over 180 day outside the USA. 

 

Otherwise if you were out of the USA more than 50% of the time (one day over 2.5 years 30 months plus one day) you will need to stay in the US long enough to swing the balance of days in the US over 50% of the last years.

 

Note you need to check if any of your out of US trips went over 180 days. Note it is 180 days not 6 months.

Thanks for your response. Thats the thing,  none of the lengthy trips, matter a fact, none of the trips equated to 180days in a given trip. I think this may be a little more complex for my comfort.
