What would happen if one of the children that you have to list on the I-130 is born a year after your marriage to your husband? The couple were married in Jan 05 and in Mar 06 a baby was born to his ex because he cheated on his wife. They worked it out, but won't this look really bad in the situation? Anyone have experience with this? His name is not on the birth certificate, but I am sure it is his and so does his wife. She doesn't want to lie, but I am getting ready to file my papers and she wants to file with me. I told her to put the child on there and hope for the best.

I-130:

* Jul 16, 2007 - Sent I-130 to Nebraska Service Center

* Jul 19, 2007 - I know it's sitting in the PO Box today

* Jul 27, 2007 - Check cashed for I-130 Fee

* Aug 2, 2007 - NOA1 Arrived in the mail dated Jul. 25

* Sep 19, 2007 - ~Touch~ Placed with I-129F

* Dec 4, 2007 - ~Touch~ Address Change

* Mar 7, 2008 - ~Touch~

* Mar 13, 2008 - NOA2 Mailed - We got an approval!

I'd like to help but I can't follow who is who and who did what to whom? Would you be kind enough to try describing the circumstances again? Please identify the people without the use of he and she, if possible.

My friend and her husband got married in Jan 05. In Mar of 06 his ex had a baby that is his. So he cheated on his wife after they got married and the girl had a baby. Now my friend is getting ready to send in the I-130, but she doesn't want to add the child, but I told her not to lie. She is worried they will see it as a fake marriage and deny him the chance for his visa/waiver in CDJ, MX. He is not on the babies birth certificate and does not have any formal court orders to see the child or any type of parenting plan so she thinks she can just slide without it. I told her that even though there is no DNA proof they could find out and it would be considered lying.

From the way you explain it, I don't see here any proof this baby belongs to the ex. His name is not on the birth certificate, there wasn't any dna test taken, for all anyone really knows besides the ex is that this baby can belong to someone else. What proof does anyone have that she didn't sleep with someone else? I think I would want some sort of proof before I go telling the world my husband may have impregnated his ex wife. Maybe she needs to speak with an attorney before she goes claiming this baby that may not be her husbands. Good luck to them both

Your re-write is perfectly clear. Thank you. I think your friend is wise to leave the child out of any paperwork. One only has the word of its mother as to fatherhood. I take it there is no intention or possibility for the child to immigrate. Officially, the child is not your friend's step-child or her husband's child.

In my view, listing the child could (unlikely) raise questions of fraud.

Thank you guys! I will let her know. Her husband is here in the US and the ex-girlfriend is here to. My friend requested to have a DNA test, but the mother won't do it. Which of course leads me to believe it is not his, but my friend is convince the child is because it looks just like her husband and her husband admitted to cheating on her with the ex-girlfriend. I will tell her to leave the child off since the mom is refusing a DNA test. Thanks again.

Tell me about it. My friend and my cousin are going through this whole I-130 thing with a El SAlvadorian and a Mexican and they are having the hardest time with double entries and children. I feel really bad for them. My friend is the worst. She loves this guy so much she lets him get away with everything.
