Received Form I-797C

Hi everyone, so I sent my wife’s packet for AOS to the USCIS about two weeks ago.

Today, we received Form I-797C, Notice of Action in the mail (three different ones. One for my wife’s application for employment auth, one for application to adjust status, and another for petition for alien relative).

My wife’s I-94 expired a few days ago an am worried because these forms say at the top “THIS NOTICE DOES NOT GRANT ANY IMMIGRATION STATUS OR BENEFIT.”

If i’m not mistaken, these forms are NOA1 right? Which supposedly protects you if your I-94 expired, no? Why do these forms say this at the top?

Each paper came with a receipt # and two provide an Alien number. One of these forms also says that the next step will be that the USCIS will schedule a biometrics appt.

So..  this is supposed to be good news, right? Since my wife’s I-94 expired, which form is the one that supposedly protects her during this time?

thank you so much.

The I-797C for the adjustment of status confirms that she is in authorized presence. The form correctly states that it does not provide “immigration benefit” as she is not approved yet but she is in a period of authorized stay until the decision is made.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

Now a US citizen!
