F2b Visa recipient has child while waiting

If he is married he cannot get the visa

if he is not married he can bring the child (with her permission), then he will have to marry her after he gets his green card to in turn sponsor her on F2A visa  (he can also leave the child with her to come with her as a derivative on this visa if that is preferable)

no way for them all to come at the same time

There are no visas for baby mammas. He fan bring the child but the mother stays behind.

 

It is sort of a catch 22. He he marries her, he want get a visa. If he brings the child, the mother stays behind. Right now, there is no way for all of them (mother and child) to come together.

 

An option is for him to come over first, obtain his green card, then go back to marry her, then apply for spousal visa. And this option will take some years to complete.

I am not sure if this still applies but when my unmarried cousin brought his kids to the US, they went to DSWD for a letter (I don't know what kind) stating that the mother is okay for the father to bring the kids with him to the US. We are on the same page with one of my brother that's currently processing for the petition. Just to make sure, we will be going to DSWD for the said letter. Whether the immigration needs it or not, at least we are ready just in case they do.

Different scenario. In your cousin's case he was bring his kids to the US. In the OP's scenario, he is asking if the mother of the kids can come over. He is bringing the kids but he wants to come to get a visa also. And, unfortunately, it is not possible because she is not his wife.
