Timeline

Hello y’all,

I am curious after my fiancé comes and we get married. After filing for AOS can he get a drivers license or does he have to wait til AOS is approved?

Depends on the state. DLs and state IDs are issued by the state and each has their own requirements.

Some let you get one during the first 90 days (married or not). Some may have this expire at the end of the 90 days.

Some may let you get one with the NOA1 from AOS.

Some may need an EAD or green card.

I’ll check out the TX dmv website. Hopefully they have useful information listed that’s up to date. :)

Someone that can help you with this is @Lucky Cat . He is from Texas and pretty familiar with the license process I have seen in previous posts. I tagged him here, so hopefully he will get back to you as I believe he will have valuable information on the license process in Texas.

Texas requires several things before they will issue a driver's license.  There are requirements such as proof of lawful presence in the US, proof of a SSN (or waiver letter), proof of residence, proof of identity, and proof of vehicle insurance (if applicable). Texas is pretty strict concerning lawful presence in the US  I had to submit my passport when I was exchanging my Arkansas DL for a Texas one.......  Here are a couple documents which define the requirements.

According to the information I found the last time I researched this, a person who has a receipt for a filed I-485 can use it to show lawful presence.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

This may have been due to REAL ID requirements...?

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

@Lucky Cat Thank you much...I did a little research on my own .....It says they will issue only Temporary drivers licence based on the timeline to be determined by DHS

Good question.........On a related note, my wife received a 6 year Texas DL using her 2 year Green Card to show lawful presence.

Nice,  can find it again but someone else reported getting a 6 years DL after he went in to renew his TDL. They didnt ask for anything they just took the temporary and issued him a 6 year.

I live in Texas. 

 

The first time I went to get a driver's licence (right after I arrived) they only issued it for 2 months which was when my i94 expired. After that I had to wait for the EAD in order to get the new one and the DL was going to expire when the EAD expired (they're usually issued for 1 year).

 

I got my green card in November and went for a DL (I didn't have one based on my EAD because I wasn't in the country for the summer). They issued it for 6 years based on the green card (expires in 2026).

First time I applied my DL in TX few months ago and the requirements they asked me:

 

- GC
- passport 

- Birth Cert.

- SSN

- Proof of residence in Texas
- 2 Different Proof of Billing under your name in the same address and not expired in 90days 
- State ID I surrender 

- Proof of Car Insurance but I don’t own car so my husband’s Car insurance

 
I got my real DL, 2weeks after my road test.
