OK, we applied for K1 in 2013 but never completed it. NOA2 and then did nothing and forgot about it.  We married in the Church but not legally in 2013.  We confirmed our marriage at the courthouse Dec 10 2019 and filed I130 for Wife and 4 kids.  How can I tell or can I tell when they even look at it?  You may remember we asked about my criminal record, arrested, sentenced, and then new judge threw it out.  We did consult a lawyer and as look as I have the innocent or that it was found not chargeable...whatever...Under US law, I am good to go .

There is no way to know when or if they have looked at your cases. They will either issue an RFE, approve, deny, or issue an intent to deny letter when they do. Usually it's an RFE or approval.

The vast majority of the time is spent waiting for somebody to get to your case. The actual review and adjudication would likely be measured in minutes.

Sometimes a case takes longer due to background checks, verification of documents, a legal opinion review, etc.

No criminal record questions for the US Citizen in a spouse visa case.  Unless you have a conviction under Adam Walsh Act, your criminal history is irrelevant.  Hopefully you filed 5 I-130 petitions, one for each intending immigrant.

Sorry, the criminal record is for beneficiary, wife. NBI comes back clean, but when we get to the 260 she will have to tell them about arrest and then supply all the court documents.

I see.  Should be no problem. Did you file an I-130 for each of the children?

Sure did. The oldest was brought up by us, but adoption recently done, so she is not eligible.  She will go to grandmother on a student visa in Mexico, where they are arranging a year long in depth Speak Spanish program and then into a University program.  We are hoping she will be able to get a tourist visa to visit eventually.

Terrific.  I take it you are the Pinay, Ruby. 😉  I press this issue because you originally said I-130...instead of I-130s and left out information about who you were talking about.  Usually it is the petitioner not posting, so without information, that's what we assume.  Grammatical errors and omission of critical information while communicating is very common for Pinays when English may be their 3rd or 4th language.  Carry on.

I am Ruby, but my English does get mixed up.  But my husband is Pinay also, adopted as baby to the USA and he gets his Tagalog mixed up, so we even ha ha

So your husband is Pinoy?  Just teasing you.  I live in Dumaguete and do not speak any local language at all. On Negros, English is often language number 4 for the locals.
