RFE: Civil documents rejected (Argentina)

Hi, all! I'm in a bit of a conundrum here. I received a response from NVC regarding the uploaded civil documents - birth certificate and marriage certificate were rejected. The message read: 

 

"Please replace this with an acceptable birth certificate from a correct issuing authority." 

 

That's exactly what I did, but the documents got rejected. In Argentina, birth and marriage records are simple photocopies from the Civil Registry's books - they can also be certified if needed. The copies I had submitted were also legalized with the Ministry of Internal Affairs. I'm not sure what's the best way to handle the NVC request for the replacement documents. Any Argentines here who could shed some light? Or anyone at all may have an idea of how to best handle the situation?

Thanks for replying! I've done exactly what is described in document requirements (read through the website back and forth before submitting), and they still rejected it. I've submitted the same marriage certificate for our I-130 stage (there were no issues). Birth and marriage certificates have the same format in Argentina, so submitted the same thing for the beneficiary's birth certificate. That's why I don't really know how to best resolve this situation.

Earlier you mentioned certified copies were available.  Did you submit a scan of a certified copy?  If you did, then call NVC.

Yes, sir! We submitted scans of certified copies. Will have to call NVC and see how we can resolve this.

Did the document contain the  big blue stamp "fiel copia del orginal" on the back or was it a certified digital copy? We submitted the certified digital copy (copy of the book but with an attached paper saying its legit and a bunch of small stamps). It had the interior minister stamp and signature and an apostille.  We got an RFE in the I-130 phase for the marriage certificate. Luckily I had an older copy of the marriage certificate with the big blue stamp and sent and got I-130 approval. I'm worried we will now have this issue with the birth certificate at the NVC phase. I only have the same digital version... not sure how to get the other version especially in lock down.

Both, my husband's birth certificate and our marriage certificate, were certified digital copies with the interior ministry stamp - same we have submitted with the I-130 (which was approved without RFE). I called NVC, and the person on the phone said the documents didn't explicitly say "Acta de Nacimiento" and "Acta de Matrimonio", and because of that they got rejected. He also said, the Embassy will reject these documents during the interview, so I have to get the "correct" documents. I ended up e-mailing the US Embassy in Buenos Aires asking them what to do. I attached the same documents we have submitted to the NVC. The Embassy responded saying the documents were correct and encouraged me to forward their response to the NVC. Which I did. It's been 2 weeks since I have resubmitted the same documents and still waiting for response. I have also asked another Argentine friend who had his CR-1 approved at the end of 2019, and he and his wife had submitted a certified digital copy of his birth certificate. All approved without RFE. I think, ultimately it's about who ends up reviewing your case.

Right, for me the issue with the RFE in the I-130 is because they didn't recognize the digital copy even though it was certified. I also consulted some friends who have successfully gotten green cards for their Argentine spouses and they submitted digital partida de nacimiento with no problems, so I think you're right that it comes to down to luck of who is reviewing. I am pretty sure you can no longer even get copies that are not digital with big blue stamp, but the doc requirements are not updated.

Yes ,on the birth and mariage certificate.

i live in cap fed ,I know it’s not the same way if you live in Provence. I call 147 for help there they told me how to do it,first ordered every thing expressed I paid a bit but it wasn’t much ,once I received the email and printed it I went to a cgp but they told me I needed a supervisor to put the blue sello and sign it so they told me there was a supervisor in a cgp in Flores ,they called her to make sure she was going to stay and that she had the sello ,watch out some times they don’t have it so you should try to call before ,I went there and asked front desk for the sello and they had no idea ,jaja ,but since I had the supervisor name I asked for here and she came over ,looked at the email and the papers that i printed and put the sello and put her signature,so watch out some don’t know much about the sello so you have to insist to know if there is a supervisor.

Thanks  so much Andressr! That's very helpful. We took it to get legalized and got the attached stamps. Not sure how we can get the Blue Stamp during quarantine with the comunas closed... but good to know it has to be a supervisor and can be done if we insist.

 

This stamp passed for the birth certificate in the I-130 phase (but not for the marriage certificate). Worried it will cause problems at NVC, though I know others have submitted similar versions and been fine...

that looks pretty good but I guess the person looking at your case has seen the old version in Argentina?.and is asking for it,
you can call 147 and ask how And if it’s possible with the lock down,also some times one person on 147 doesn’t know call later to another one because not everyone on 147 has the same experience.
