Trying to remember. Seems like I recall something about Federal troops being used for violence and civilians.  Can the President do it? 

I know I pulled riot duty as a guardsman.

Willful I can see.  Premeditated?  Maybe, if the rumors of GF being Chauvin's boss at the night club (and having fired Chauvin) bear out.

And don't get me wrong... from the evidence I have seen thus far (And I realize an investigation is barely started) I hope Chauvin gets the max penalty.  Death penalty preferred.

Seems if I remember correctly,  Wallace was using the guard to stop schools from being desegregated.

The Posse Comitatus Act (and thank heaven for it) has a couple of exceptions -- one, the Insurrection Act.  This is probably what will be used.

Giuliani should know that's not possible. Premeditated knee to the neck?

 

I think second degree is definitely possible, but they might find the "depraved heart" burden too lofty, third seems like an easy one though. If there's any substantial difference in sentencing for second and third, I'd say go for second, if not, go for the easier one. Trying to charge him with first degree though requires explicit proof of premeditated intent, the loftiest of burdens, and without it, the guy wins. Definite no without.

 

I'm also interested in what charges the other officers there might be hit with, the intent is clear to charge them with something.
