Trying to remember. Seems like I recall something about Federal troops being used for violence and civilians.  Can the President do it? 

I know I pulled riot duty as a guardsman.

I think second degree is definitely possible, but they might find the "depraved heart" burden too lofty, third seems like an easy one though. If there's any substantial difference in sentencing for second and third, I'd say go for second, if not, go for the easier one. Trying to charge him with first degree though requires explicit proof of premeditated intent, the loftiest of burdens, and without it, the guy wins. Definite no without.

 

I'm also interested in what charges the other officers there might be hit with, the intent is clear to charge them with something.
