The 90-day thing is to keep her in status, that’s all. Not filing AOS by the time the 90 days on her I-94 are up means that she’s officially out of status. There was a similar thread a few weeks ago. I understand your concerns, you don’t want to do anything wrong. Officially she is out of status. Can she be deported? Strictly speaking, yes. In reality, the chances of ICE getting involved with the law-abiding wife of a law-abiding USC who can’t file the AOS on time due to a global situation, the like of which has never been seen before are slim to none. There are much more pressing cases that ICE are dealing with. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

I actually just ordered another copy of our marriage certificate from that exact website, but I do live in CA. The website told me it'll take at least 20 days for the order to be processed, that's a long time..

 

In the beginning of the process you get to choose which state you got married in (where the marriage was recorded), so I assume that website works for several states, not just CA.

But for OP it's not currently a solution. VitalChek forwards the order on to the vital records agency who searches for the record based on the information the applicant provides. The vital records agency produces the certified copy of the record and ships it out to the applicant. Right now in Cook County, that forwarded order isn't being processed; thus no access to a vital record from that county.

That's true, I remember it stated something like that. VitalCheck would send the "request" within a day, it was the other party (that actually sends out the certificate) that was taking so long. So yeah, if "the other party" isn't processing anything then it won't help either.

My advice is to not worry. When you’re able to get the marriage certificate then you can send off the AOS paperwork. Just have everything ready to go and send in the forms ASAP when you get the certificate. Best of luck!  You’ll be fine.

That will result in a flat-out denial......that is definitely a required item.  You should just wait it out while continuing to contact all available resources there in your county.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

The important thing is you got married within the 90 days. Many people successfully adjust status after 90 days. Is it advised? No. But I can tell you from first hand experience that it is usually not a problem.  Don't send her back home!! )))
