Work visa for nephew

Need advice for work visas: 

 

My husbands nephew has a degree in communication and advertising and would like to come to the US under a work visa. I work for a company that could hire him for sales and is willing to help with this process. 

 

what’s the visa that he would need to apply for? And can we do this process on our own without a lawyer?  I was able to get my husband citizenship without a lawyer, but that was over 10 years ago. Hope I can do this for our nephew a save some $$$

Your company’s lawyer would work on this- not you.  Also just throwing it out there that there are pleennntttyy of US citizens that can work in sales. (AKA getting a visa for this type of work would be close to null IMO)

Approved: 8/31/15                                     Received: 9/8/15

 

EAD

Received: 6/20/15

 

Removal of Conditions I-751

Filed: 8/14/17 at VSC                                 NOA: 8/15/17 Received 8/21 by mail

Biometrics: Dated: 8/25/17   Received 9/2/17   Appointment 9/11/17 

Approved: 10/23/18 -no interview

If you are the employer you would need to apply for it, not him. Hard to do it successfully without a lawyer. The lawyer will advise you which particular work visa type (note some are oversubscribed and only available via lottery), how to fulfill labor market requirements to prove there is no one in the US who can do the job, etc. I understand there are more stringent or additional requirements when the employer is a relative, but again a lawyer is best to advise you on that.  It’s way more complex immigration-law wise than getting a spouse a green card.

Unfortunately, this is not a skill set that is lacking among USCs and LPRs, so chances are not good.
