NVC whilst still in Military

Hi

Some background to our situation

 

My USC wife is currently living here with me in the UK on a spousal visa which expires June 2022, I am serving in the Army and am due to complete my 22 years service in May 2022. We recently filed our i-130 petition in March given how long it has been taking to get approvals and is currently sat in Nebraska service centre. Our intention is to stagger the NVC phase to allow for medical and interview to be taken December 2021 - March 2022 in order for us to be able to move back to the US at the earliest opportunity after March 2022 when i will be on Terminal leave before discharge and before her visa expires and has to leave the UK. 

 

My question is this, i know i will be required to show Discharge papers or evidence of Terminal leave from the forces at embassy interview, this will not be a problem. The problem i fear is what do i submit to NVC several or more months before regarding my military service which they will no doubt ask for to get us to that point in the process. Obviously the problem if the NVC want something i cannot provide until nearer the time of retiring will lead to my wife’s visa expiring, temporary housing to be found etc whilst the process completes.

 

Any thoughts appreciated!

Just stay in contact with NVC once the time comes.  You can delay as long as you like.  With the Covid 19 situation now, it will be impossible to predict timelines going forward until things are back to normal and backlogs of interviews are cleared.

We are in a very similar position with timing etc. My husband is currently serving in the army too and unsure of when the “right time” to sign off would be. He is a bit hesitant because if this immigration process doesn’t work Out and we stay in the U.K. he wants to stay in the army. We only submitted the I-130 in May but I want to start preparing for the NVC stage and worried his military records won’t state an end date and they don’t accept that he’s going to sign off in time for interview and to activate his visa when it’s Issued. 


Just wondering if you found a way round your issue or what you planned on doing at NVC stage? Any suggestions would be greatly appreciated ☺️

Good to know we are not alone navigating this particular journey!! Fortunately I don’t need to worry too much about the signing off part as I’m coming to the end of my full service anyway. We submitted online in March and its in Nebraska, assume you filed online too? As of now Like yourself trying to be proactive and assemble everything for NVC. What we have for my military service is a ‘Personal Profile Report for an Employee’ from my HR Dept, it lists everything from my Passport number and NOK details to assignment history, including an engagement/contract summary which details my projected termination date. So once signed off that would give you an end date. Our thinking and hope is that this will be acceptable knowing you have to provide actual proof of ‘terminal leave or discharge from the forces’ at Embassy interview. If that turns out to be insufficient at NVC stage then we are not really sure what to do as yet other than have to wait until we have proof of discharge etc and then do the NVC stage given the i-130 doesn’t expire so to speak if you keep in contact with NVC.

Yes! I haven’t seen any mention of similar situations (Although a little different) relating to military until yours. We submitted online and our service centre is also Nebraska! Okay so if my husband also requested his ‘Personal Profile Report’ this should hopefully cover everything. Out of curiosity how long did it take for you to get this from HR? I would say especially in your situation because you have served your full military career and coming to the end it should be accepted- fingers crossed. We have said from the start my husband will sign off when we get to NVC because it’s the easier stage to get timing ideas. Think our plan will still have to be he signs off at NVC stage then request his report which would say an end date. But because of Covid it makes it almost impossible to know anything now.. The profile report was printed off there and then when i asked for it so no rush over that. Even if signed off i think there would be a way to stop it and carry on in service if things didn’t look like working out, not as if the British Army is oversubscribed at the moment lol. We are heading to Colorado, yourselves?

That’s good to know thanks! Well yes that’s true lol... Let’s hope it doesn’t get to that though. Cool! Always wanted to visit Colorado, we are heading to Florida. I’ve got another question military related were you ever stationed abroad? We don't know if we may have caused a little issue with things later on in terms of places “lived in”.

The NVC will need those documents. You can delay at the NVC to do so but it may mean that your USC spouse needs to return and be apart longer than you were anticipating.
