Hi all, I was wondering if anyone has any suggests for me.

 

I applied for a social security number the day after i married my k-1 visa petitioner. This was back in february. My I-94 has since expired. I just called them to find out where the social security number was but apparently they were not able to verify my I-94 in time when it expired May 10th. Is there any way i can reapply for the SSN? My wife needs it for me to be on her healthcare plan.

 

I have applied for my AOS already so i could wait it out with thaat, but ideally if i could get it sooner that would be great. Thanks for the help!

This is actually not correct.  You can be added without an SSN, and when you receive it, update.

This is true. I arrived on Feb 12th on a K-1, i-94 expired May 11. Partner added me to healthcare plan without SSN. Although I was added for my i-94 ran out, I did not have (and still do not have) a SSN. If it is any help, it is the Molina provider.

I’m not sure how to deal with the SS office, one would imagine since you submitted the application directly with them 3 months before the i94 expied and they didn’t process it is a problem at their end not yours, realistically speaking if they did this for everyone, not many people would get a SSN.. hopefully since you applied for it prior to submitting AOS you ticked the box that you need USCIS to process it on your behalf. 

 

No SSN is required for health insurance, my husband recently added me to his and all they required was an acceptable number from photo ID. I gave my Aussie Driver licence number, since (other than my passport) it’s the only photo ID I have and carry.

You have to wait for your EAD to obtain a SSN now. As others stated you do not need a SSN to be added to the plan; I would ask to speak to a supervisor or manager if they continue to give you a hard time.

They may be able to use your Alien number instead for insurance, I had a SSN delay as well and that's what the insurance company told us to try (after asking a few people). My SSN arrived shortly after though and we were able to update.

It actually depends on the Employer's policies as well. 

I work for the State of California and have health coverage through CalPERS. Unfortunately, because my spouse does not have an SSN or ITIN, she cannot be added to the plan because CalPERS also uses the SSN for internal accounting and identifcation for other agencies. 

 

I am still waiting for a followup to see if there is a way around considering even the IRS website says an SSN is not required: https://www.irs.gov/affordable-care-act/questions-and-answers-about-reporting-social-security-numbers-to-your-health-insurance-company

Also, multiple searches pertaining to Section 6055 of the ACA seem to state that a DOB can be used in Lieu of an SSN.

June 10, 2020 - Form I-130 Accepted

June 11, 2020 - Form I-130 I-797 PDF available for download with priority date of June 9, 2020

June 16, 2020 - Mailed I-485 packet* along with I-131 and I-765

June 18, 2020 - USPS confirms packet delivered

July 20, 2020 - Credit Card charged

July 27, 2020 - I-797 letters received for I-485, I-765, and I-131 with a received date of June 18, 2020

August 10, 2020 - Notice of RFE for I-485 mailed. 

August 13, 2020 -  Red RFE notice received via mail. Notice requested proof of residence for 864A sponsor. 

August 13, 2020 - Mailed RFE response to USCIS**

August 17, 2020 - USPS confirms that RFE response was delivered

August 18, 2020 - USCIS Notification confirming receipt of response for RFE

September 24, 2020 - Received I-693 Deficiency Notice

January 19, 2021 - Form I-130 Approved and notice sent to beneficiary with notice available immediately online

January 22, 2021 - Form I-130 Approval Notice received by mail

January 29, 2021 - Biometrics notice received for the I-485 and I-765 dated for February 17. 2020 at 1pm

December 30, 2021 - I-797 notice received for I-765 and I-131

May 24, 2022 - AOS Interview Sacramento

May 26, 2022 - Status updated to "New Card is being produced" Green Card Approved. 

 

*Packet was mailed without I-693 medical. Will wait for an RFE and take it to the interview. Also, tax transcripts were not available at the time so copies of the tax returns were sent and a cover letter explaining why. 

 

**Included tax transcripts in RFE response since I was now able to gain access since sending the application.

Did you call your local SSA office? I was in a similar situation and I was able to get my SSN. They called my husbands job to confirm the SSN was needed to add me on his health insurance.
