Visiting husband in USA before DQ

Hi there!

 

My I130 was approved on 28th April, and we submitted all our docs to the NVC. My husband is not very well at the moment (an old football injury has resurfaced) and I would like to visit him for a week or 2 to help him through, as I haven't seen him since Dec. 

 

Is this allowed?! I will definitely only be visiting, as obviously I will have to come back to the UK for my interview at the embassy.

yes if you already have ESTA or a visa.   Spouses are exempt from the EO travel ban.

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

is this allowed? In general yes.

 
will you be allowed in? That is a different issue. The fact i-130 was approved and your recent visit are not factors that guarantee you will be allowed in this time.

Hi Hannah,

 

I visited my husband several times during the process, and I had no issue entering the USA since I have a good reason ro be back to my country (job, property....),

I always travel with my job certificate, and some paperwork justifying that I am the owner of a property (car, house,...)

 

I’ve never been asked to show them, but they are always with me in case of.

Timeline

Since I received my DQ, I was advised by my lawyer not to travel to see my husband as I would be considered a flight risk. Before that, I traveled pretty much every month to see him with no issues. The DQ email from the NVC states not make any travel plans, sell property, etc at this time. To err on the side of caution, I won't be seeing my husband anytime soon, heartbreaking as that is for us.
