I-864 question

Hello y’all,

I am curious I know I-864 is what I have to file and what my joint sponsor (mother) has to file. My question is she claims my children and I on her taxes so for household size on my I-864 do I just put myself? Or count all of us? As she does not live with us but she is on my lease.

You don’t use the I-864 for a K-1. What visa type are you applying for?

K-1 and that’s what a guide said to use. Also another person on this forum said. Which form do I use then? would the joint sponsor use the same? As I see there’s I-134 also so confusing

I-134 for K-1 visa.

I-864 for AOS (after entry on the K-1 visa)

If you read a guide that said you need an I-864 for a K-1 packet then stop reading that guide. It’s the I-134 at this stage. The I-864 isn’t needed until the immigrant is here, you are married, and you are filing for adjustment of status.

I assume my mother joint sponsor files the same form. Correct ?

There is only one sponsor for a K-1. You will need to check to see if the embassy will permit your mother to sponsor. Now, if you are below 100% of the poverty threshold, do you have a plan in place for the immigrant’s healthcare? That’s your responsibility. Also the cost of feeding and housing an extra adult who cannot work for many, many months and the cost of the AOS? A K-1 is often a poor choice for a low-income household.

If she claimed your children as dependents as well, then they should be included in the I-134. The tax transcripts of hers is going to show who she claimed as dependents.
