Thank you all for the past information!

 

I currently have two questions:

 

1. I am the one who made the account to start the CR-1 process, so I should only list the USCIS Account Number that was generated for myself on the i-864, correct?

 

2. My income is from invoices that I electronically send to clients and they then pay online through a credit card payment portal.  I have no 1099s to prove my current income.  My best option I can think of is to print out a copy of my business bank statement/history, accounting software listing of invoices sent, and personal bank statement/history.  Is this sufficient or is there something I am not considering that I could do?

 

3. I have also secured a joint sponsor who meets the qualifications and my wife and I have assets that alone are well over the minimum requirements times 5, will these things help with the problems of not having 1099s?

 

4. 2016, 2017, and 2018 were building years for my business and I did not meet the financial requirements during those years.  Does this impact any of my above questions?

 

5. I do not live in the USA, so I would have significant trouble getting anything other than a printout from my online banking.  Will this be a problem?

1) The USCIS account number would be for you, if you have one (not your spouse). This is not an alien number or your petition receipt number.

 

2) Your current income would come from the most recent year's US tax return. See the "total income" line.

Anything you earned this year so far is revenue, not income.

This assumes your current income will continue upon returning to the US.

 

3) Assets can be used in lieu of income. It's a 3:1 ratio for a spouse for a USC, not 5:1. But obviously more is better since the public charge decision is a judgement call by the CO based upon the totality of the circumstances.

A joint sponsor is unnecessary if your income and/or assets suffice. They look at each sponsor separately. If you qualify, then there is no reason to use a joint sponsor. having an I-864 from a joint sponsor on hand if needed, however, is not a bad idea.

 

4) It will be considered in the totality of the circumstances. I'm assuming you haven't file 2019 taxes yet. If so, your 2018 income is what they will use as your current income.

 

5) Generally they want to see 12 months of statements.

You will need to show sufficient intent to establish US domicile (or actually move back to the US first and establish US domicile).

So, to clarify for #2, on Part 6, Question 7, I would list the income from 2018 (the last year I filed taxes for?  Can I add information about 2019 since that year is finished even though I haven't filed those taxes yet?  It shows a much better picture of my increasing income.

Nothing technically stops you from adding it, but I would not expect it to be considered as they don't know what's income and what's not (for instance, I could show them a $1 mil contract in 2019 but they have no way to know if it ended up costing me $1.1 mil to fulfill that contract).

Other than a separate document, there no way to document your ongoing revenue.

 

geowrian made a statement that MUST be taken literally, in that unless the tax return is filed, any "revenue" from 2019 is NOT "income".  It is only revenue, until you have filed the tax return to claim the expenses against the revenue.  The only way to show increased income in 2019 over 2018 is to FILE the 2019 tax return.  What's stopping you?

That's a fair question, and the only answer I have is laziness due to the extension we have and the hope to get everything for the NVC turned in faster.  I'll get on it since I know it can only help my case.  Thank you!
