He can enter if the visa was issued before June 24, 2020: https://www.federalregister.gov/documents/2020/06/25/2020-13888/suspension-of-entry-of-immigrants-and-nonimmigrants-who-present-a-risk-to-the-united-states-labor

The suspension and limitation on entry pursuant to section 2 of this proclamation shall apply only to any alien who:

(i) is outside the United States on the effective date of this proclamation;

(ii) does not have a nonimmigrant visa that is valid on the effective date of this proclamation; and

(iii) does not have an official travel document other than a visa (such as a transportation letter, an appropriate boarding foil, or an advance parole document) that is valid on the effective date of this proclamation or issued on any date thereafter that permits him or her to travel to the United States and seek entry or admission.

Unfortunately its not what's happening in reality.  He filed H1b visa renewal in January, had an interview, and got approved. The pandemic happened in China in Feb, all the local consulates and embassies closed down and hold off his passport in the embassy for 5 months for no reasons and updates. In June or July, he got his passport back with no DS160. He met all the exempts that allow him to apply for H1B visa again to enter US, but non of the embassies in the whole world will accept his emergency appointment request. Long story short, he has been staying in Cambodia over a month trying to come back to the US. Its not that simple if there's politics involved.

Thats why we want to tie the knot legally so he can be the spouse of the us citizen in case more "drama" happen in the future..

Hello all, I am a June 2020 K1 filer just checking in. Any update on current processing times?

If your timeline suggested adjudication date is like mine, every day that passes the suggested date moves back another day. That’s a slight exaggeration, but only slight. At one point it said likely processing/adjudication of the I-129F as early as Nov, now almost the end of January.

There is a queue and I see people getting their NOA2s, so I know our date will come. It’s the NVC backlog that I’m dreading, and also the fact that our embassy hasn’t reopened for routine visa processing.  By the time we can Interview, I’m expecting no earlier than a year from now.

5 - 7 months is the normal estimated wait from NOA1 to NOA2, but probably we should expect delay because of the pandemic. They're currently processing March Filers now, and there's some left still waiting for the approval since Feb, Jan and Dec.

We have June filer group on Facebook and there's one couple just got approved. Here's her timeline

NOA1 : 22nd June 2020

RFE  : 18th August 2020,

The case was updated on September 8th and then she got approved on September the 17th.

Hi guys. How is everyone? I would just like to ask if it's easy to change the beneficiary address and US Embassy location where we originally planned to process the K1 visa. Because now, things got complicated and the company where I'm working is letting go and terminating employees and I might be one of those. So, I'm looking at returning to my home country. So can someone please enlighten me, on how we can change addresses and update my location so that I'll ve able to process in Philippines, instead of Qatar. Need your insight here guys. thank you.

sorry forgot to add my service center is the texas service center

What is the first three letters on your NOA1 ? Because it's indicate the USCIS service center which is processing the petition.

As I know all I-129F Petitions are required to be sent to the Dallas TX lockbox which is not and different from the Texas Service Center. Then, the USCIS lockbox sends to a service center that it chooses based on balancing workload. 90% of K-1s are sent to California after in processing by the Dallas lockbox. And some got transferred to Vermont.

WAC is the California Service Center

EAC is the Vermont Service Center

Wow I had no idea of this information. I just assumed it was based on what region I lived in. Yes my receipt starts with WAC.

Alright, then your service center is in California.

Best of luck, just wait and have patience. 🙂 wait about 5-7 months, it might be faster or slower than the estimation times.

If you wish to have your immigrant/fiancée visa file transferred from one Embassy to another U.S. Embassy/Consulate, contact the appropriate U.S. Embassy/Consulate directly in the country where you wish to apply and submit Form DS-3098 for case transfer. Please click here for the full list of all U.S. Embassies and Consulates overseas.

The old Embassy will need to receive a formal file transfer request from that U.S. Embassy/Consulate in the country where you wish to apply. Upon receipt of this request, they will immediately forward the file for the New Embassy to process. (Expect up to a 30-day delay)

Once you contact your New Embassy you then can discuss the transfer of your fee if you have paid it prior to the decision of transferring your case to your new embassy. Be sure to have your payment receipt available.

If your case goes from embassy to embassy, then NO you don't get a new case number. The case number will begin with original alpha nomenclature i.e.. AAAXXXXXXXXXX. If her case comes from NVC then you will have a case number starting with the embassy that you will interview in. To make your payment using your old embassy's case number you establish your profile with that case number then you link your payment to your profile.

If your case is still with NVC then send an email to asknvc@state.gov and include your case details to include case number, names (petitioner and beneficiary) and dates of birth for both with any case number you have  received. Further, include the embassy that you want the file sent to with the notation that the beneficiary has legal residency in that country. Send it to the attention of "Supervisor" as they are the ones who approve a transfer.

Your service center is CSC California Service Center. Your profile says Texas. You may want to make the change so it is accurate for your current service center.
