Since you are currently outside of the US you cannot intend to adjust status from tourist status; i.e. must be completely honest at POE and will subsequently be denied entry per INA 212(a)(7)(A)(i)(I) and INA 214(b).

 

Do note that the US restrictions are only for land entry and ferry travel. The next day, I notified NVC of his new ineligibility for the K-1 and we went to work on the I-130/145 submission packets!

Timeline

Looks like Montreal embassy is interviewing cases with NOA2 dated June 2020, so it will be a while for us. How are other countries doing? Seems like whole process is going to take about 15-18 months for Canadian beneficiaries!

I saw 2 italians who get their interviews in May and their No2 were April and May 2020 :( of course  the time depends on the country and how crowded it is

Just here to vent a bit as a long time lurker.  NOA1 in June of 2020 and still on "Case Received" status.  No RFEs and no communication in the slightest. Multiple inquiries sent in but only auto-responses received.  Bit of a bummer as we've tried to just do it the right way this whole time. What's even more concerning is how seemingly straight forward our application is - no kids, no prior marriages/applications, stable jobs and addresses, long term relationship with documented meetings provided, no criminal history, no IMB and even prior work visas issued. I've used CaseTracker to search case numbers around ours and as far as I can see we're about one of a handful without any action. Wish there was a bit more rhyme and reason as we seem to have won an unlucky lotto ticket.

I'm so sorry that you've had such a hard time with this. I got my NOA2 on 4/20, and that was a horrible wait in itself. I know some people say it doesn't necessarily help, but have you contacted any Congressmen about your case? I first contacted my state Senator and then my US Representative and filed two "out of normal processing times" inquiries. Not long after I contacted the Representative, we were approved. If we hadn't been approved by the time I heard back from my US Representative, I was going to file a complaint with the USCIS ombudsman. I really hope you get some good news soon!

I did back in March and April but unfortunately just received generic responses. I am going to look into the ombudsman you mentioned and see if that may be a potential way. Thank you for the suggestion. As I've been tracking thousands applications in our time frame, I thought for sure it would be approved in late April or early May but unfortunately nothing and our one year is right around the corner. My first thought was they simply lost our application but I recall reading the Lockbox actually scans everything in rather than keep a paper file so I'm just trying to understand what's happening. While I'm happy for people, it does hurt a bit seeing all these November and December of 2020 applications receiving NOA2s knowing that our journey is likely not even halfway over yet.

I feel your pain, I’m keeping you guys in my prayers! This whole process is spirit breaking. While some couples have it so easy ,we found love in another country and have to wait for all this paperwork to marry someone we love.🙏🏽

Unfortunately so! Hopefully you obtain an interview date soon as well. I know Montreal is barely interviewing for K1s with NOA2's post-Covid which is very frustrating.
