Which proclamation? The Executive Orders from April and June do not apply to K-1 visas. The proclamation supposedly coming later this week? Well, no one knows what is really in it until it is signed and published.

The one from last April and June. I didn’t know there’s another proclamation but I do hope K-1 visas are not included.

Timeline

I know it's early and theres still lots of uncertainty about USCIS furloughs, future executive orders, etc, but I'm reviewing the requirements for all the future things we need to submit. My lord, the I-944 looks dreadful. I really wish K-1s and IR/CR1s were exempted from it, considering the I-864 should already guarantee against public charge issues. It feels like a major invasion of privacy for brand new immigrants. The chin is still up, looking forward to a future together, but it feels daunting and likely expensive to get things translated from the original language, prove language skills, etc. I'm less concerned about the credit score than proving all the other things. Hope all y'all are looking ahead, too, so we can be successful on first submission of all the next steps without RFEs.

The I-944, Declaration of Self-Sufficiency is such a new form. Many times, we see the form go through many machinations over time. I can remember at the time we were going to have our interview there were three forms to submit then they consolidated them into the DS-160, Online Nonimmigrant Visa Application but having only one page. Now there are 4-5 pages for the DS-160, Online Nonimmigrant Visa Application. This doesn't give you much relief as the I-944, Declaration of Self-Sufficiency is very invasive but what part of this process is not. Remember this "the man who has the gold makes the rules". It means for whatever process you have a desire to be approved for, whether it's a credit card, a car loan, a driver's license, or a visa. 

The rules that are in placed are the rules. Trying to circumvent those rules by using what you think you should do to attain whatever it is you are trying to attain will not get you the approval. You must adhere to their policies or instructions.

 

So, the man who has the gold (gold = the power to approve) makes the rules (the rules or requirement to get whatever it is you want from them i.e. a visa). That is what is meant by the statement. Since you don't have the gold you can't make the rules to which you will abide by. If the instructions, ask for "red" and you submit "black" because you think it just as good as "red" but "the man" has his/her requirements for a reason hence their requirement for "red". Their reason you may not fully understand (this is where education about the requirements comes in handy) but to get what it is you are after you must follow their requirements.

I-944 is a USCIS form for Adjustment of Status. DS-5540 is a DOS form that may be requested at the Immigrant Visa interview; seems like some K-1 P3s also mention DS-5540:

Immigrant Visa (IR-1, CR-1, F2A, etc.) individuals don't need I-944 since they don't do Adjustment of Status in the US.

 

Both DS-5540 and I-944 have similar section headings:

  • Information About You
  • Health Insurance
  • Your Household Size
  • Your Assets, Resources, and Financial Status
  • Your Education and Skills

A practical difference is that DS-5540 doesn't ask for US credit report or score from visa applicant. Overall, I-944 and DS-5540 are tools for INA 212(a)(4)(B)(i) purposes: "In determining whether an alien is inadmissible under this paragraph, the consular officer or the Attorney General shall at a minimum consider the alien's- (I) age; (II) health; (III) family status; (IV) assets, resources, and financial status; and (V) education and skills."
