Submitting I-751 Petition to Remove Conditions on Residence. Wife's British passport expired a few months ago - will it matter?

Hello,

 

We're in the process of submitting 1-751 - Petition to Remove Conditions on Residence.

 

My wife's British passport expired several months ago. We've read through the info on the USCIS 1-751 and there's no mention of passports needing to be submitted.

 

Can anyone confirm if this is definitely the case, please? There's still time to renew the passport but Brexit and Covid-19 may be causing delays so it would be far easier not to have to do this step.

There are many reasons to renew the passport - one of them your wife being unable to travel internationally without a valid passport, but I think ROC is not impacted by it.

Yes, my wife fully intends to renew for the reasons you mention. We just needed to know if an expired passport causes problems/rejection on the I-751.

Expired passport has nothing to do with ROC.

Nobody is required to have a valid passport unless they wish to travel internationally

Renewing a British passport whilst living here in the US is very easy and fast. In peacetime it’s around 10-14 days. The current situation may have temporarily changed that (is the passport office essential? Who knows...) but all things being equal it’s a very quick and painless procedure. You start the process online, mail

off the passport to the UK and receive the new passport plus the old passport with a corner removed by courier soon after. 

 

I am just mentioning this in case the reason for not renewing it was due to a concern that the process would be complicated.

We have no problem with renewing, it would just be easier not to have to right now, i.e., if we can get away with not bothering at this point, this would be preferable. 

 

If it was important, I'm sure the I-751 USCIS page would clearly state something like 'all foreign passports must be up-to-date and not expired'.

 

We just wanted to be extra sure, obviously it's stressful and expensive stuff to mess up.

As others already said, you don't need the passport for ROC. If she gets the option of keeping her expired passport when she applies for a new (in my home country you get to keep the old/expired ones for example), then she should. If she plans on filing for naturalization in the future they sometimes ask for current and old passports to see stamps of travels etc.

Don't know about other countries but the UK returns old/expired passports unless they're badly damaged. They send you your new passport and the old one follows in a separate package a short while after. We'll be sure to not throw out the last one that shows all the entries in and out of the U.S. since starting the K1 process in 2017, so thanks for the reminder. 🙂

Before the 18 month, a prior to that 6 month. extension letter - you could get a ADIT stamp to extend the "status"
