I-864 and submission question

Hi everyone!

 

I have a couple questions and hoping you can help. 

 

First question re: I-864A. 

I am sponsoring my husband, so I have filled out the I-864. I am using my mom as a joint sponsor for financial reasons, so she has also filled out an I-864 (NOT an I-864A). We do not live together so she does not qualify as my “household member.” 

 

My mom and dad are married and live together, and they file their taxes jointly. HOWEVER we are only using my mom as the financial sponsor (she makes well above the requirement with her own salary). We have included her own W-2 form with her taxes so that the NVC can extrapolate my mom’s earnings from the joint taxes she files with my dad. 

 

I did NOT have my dad fill out an I-864A as we are not using his salary or their joint assets (house, etc.) to reach the financial minimum. As stated, my mom gets there on her own, so we do not need any additional sponsors.

 

Do you think this will be a problem? I don’t see why it would be, since my understanding is that you only need a household member/I-864A form if you are using said household member’s income. In our case, we are not. 


My second question is pretty stupid. But I have already submitted all of my documents to NVC, as of May 10. At least I THINK I did... As you can see, in the screenshot below, it shows “SUBMITTED.” However, the red “SUBMIT DOCUMENTS” button is still present in my profile, meaning I can still upload stuff? I just wanted to confirm that my documents HAVE all been submitted and are in review with NVC, right? 😅  Screenshot attached.

 

Also, you can see that each document was submitted on a different date. So what date do they consider my case “submitted” from? From the last submitted document (May 10)? I guess I’m just used to the USCIS part of the process where they actually sent you a letter saying everything has been submitted (NOA1) and they give you one single priority date... and at NVC stage, there’s nothing like that.

Your mam is not partnof your houshold, but her income will be for a houshold of 3 (minimum) because of her, your father and sponsored immigrant.

 

Nobody will extrapolate current income from w2s etc.
 

Tax returns by definition are "past" income. By definition it is also "taxable" income.

 

Current income is based on what you are getting right now (i.e. paystubs, disability etc). This is regardless if it's taxable or not. You don't prove current income by showing previous year's returns and w2s.

 

Whichever is higher (past returns or current income) that's what is looked at in the equation.

 

Make sure you submit all that is required. You can also submit fresh documents with updated info (perhaps items you missed to "mention" before) or simply bring it to the interview. It's the latest version of the particular document submitted (like ds260) that will be looked at at the consular interview.

 

there is no concept of "priority date" once at NVC stage. It is only relevant earlier and especially to those that fall into visa categories that are issued in limited numbers per year.
