Question about Form I-864

Hey VJ,

I am filling out the Form I-864 now. I am at Part 5. I filled it out correctly, but it's stating my Household Size is 3. Actually, it's only my wife and I so it would be 2. Is this something I need to fix with crossing out and putting a 2 with a pen after I print it out? Or leave it as is?  I don't want to submit incorrect information. I attached an image. Thanks.

That's why you have 3 instead of 2.

Correct.

I get that it may sound counter-intuiative as you are married. But you cannot count somebody more than once, and your wife is counted in the top #1, so this should be 0.

Actually, to count the wife in your situation would be to violate two separate and consecutive instructions directly above on the form.  Everything below the instruction not to count anybody twice is the instruction that everything below is for counting people who are NOT sponsored in this affidavit.  Your wife IS sponsored in this affidavit.

Hi pushbrk, I'm not quite understanding, sorry! It sounds like you're saying that I DO need to put "1" in number 3?  If I do so, it says I have a household of 3 though. I re-read your reply a few times and I'm not quite understanding. thanks

I have another question on this form.  On Part 6, it asks for Sponsor's Employment and Income. I chose #4 Self-Employed as a/an (Occupation).  Number 7 asks for "My current individual annual income is".... 

well, I really pay myself from my company. I don't know what I will pay myself this year. What would I need to put here?

Are you really self employed or are you an employee of a company you own?  It's not the same thing.

 

For the "self employed" current income is the total income line from the 2019 tax return.  That equates to "taxable personal income".  Self employed have many tax advantages.  The other side of that sword shows when sponsoring an immigrant.  All those deductions reduce the actual income you can "use" to sponsor an immigrant.

 

There is no question about 2020 income.  If you're an employee of a company you own, then your current income comes from a pay stub.  If you aren't paying yourself on a regular basis, your current income is zero.  For the "employed", current income is your current gross pay for a full pay period times the number of pay periods in a full year.  Not 2020, but a full year going forward from NOW.

Not sure what your CPA suggested but if you are both self employed and employed, you should state your current income as the total income line from your 2019 tax return.  Self employed AND employed is considered self employed, because your self employment income is not income until it appears on the total income line of a tax return.

Thanks for letting me know this. Unfortunately, I already sent it in, and yes I did just choose Self Employed but on the current income spot, I put a $ amount that was a little higher than last year. I hope that does not turn out to be an issue where they won't accept it and there is a long delay?

You'll just have to wait and see for NVC, but for the Consulate, you'll need evidence of current income.  They will just look at the 2019 tax return as the evidence.  If it looks good, there should be no problem.
