I do not like the way VAWA is thrown as a solution to any type of marital issue. Because of misuse of VAWA this program may be scrutinized and altered which would penalize people suffering real marital abuse.

To be honest you don’t have to many options here but to answer your question accurately, please reply to the following:
1. What Visa did you enter the USA on?
2. Have you ever overstayed a US visa in the past?
3. Did you come here with the intention of getting married?
4. How long have you known him?

5. Have you suffered any abuse? If so please give a couple of examples.

6. When and where is the AOS interview?

7. does he have diagnosed mental issues or this is only your interpretation?

It saddens me to read these kind of comments here. I didn't put here any details about how he emotionally and mentally abused me, yet I feel like being judged. I already talked to some legal counselors and advised me what to do next.

Thanks for all the comments here.

Thanks for all the comments here.

If you post incomplete info, you will get responses based on that.  Also, it is not a great idea to be posting here under two accounts.  It diminishes your credibility as a member.

Since you've already talked to some 'legal counselors who advised me what to do next,' what were you hoping to accomplish by asking here?  Confirmation of what they've told you?

To which I would add, why would OP want to file a case when on the first post she says that she has no intention of pursuing a GC... Am I missing something?

OP, what's the point in posting here if you already talked to legal counselors?

What most people here are saying is that -judging by the way you presented your case- it doesn't seem to be fit to file for VAWA. People give advice based on the info you give them.

Also, why do you want to file for VAWA when on your first post you said that you have no intention of pursuing a GC? Am I missing something?

The one thing we do not do on VJ is judge. We can only comment on the information supplied.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

There's no violence or verbal abuse. We agreed that he'll cover the expense of my travel back home and give me some money from our joint tax return.

Honestly I wish you the best and Im sorry your marriage didnt work out. I do want to point out though that filing any kind of fraudulent petition with USCIS is a BAD IDEA. Specifically one can not file a VAWA petition claiming abuse when no abuse occurred. Some 'legal consulars" assist people in putting together cases simply to collect the fees. But the filing is done under your name, under penalty of perjury. You are 100% responsible for the contents in your filing. Do not allow an unscrupulous legal consular encourage or assist you in creating documentation to support a false claim. Generally speaking if you have to 'twist' stuff to make it work (fit) you are doing something wrong.
