Affidavit of Support question

Hello, 

 

I just have a question regarding on affidavit of support. My father is preparing an affidavit of support for my sister and he haven’t filed his taxes for 2019 but he submitted an extention at IRS. So he will file his taxes this coming october. Is it fine if he submitted an affidavit of support for my sister without the 2019 tax return transcript and just attached his last 3 tax return transcript from 2016-2018?

If an extension is filed, the 2019 taxes won't be due until the extension is due. The previous years would be used instead, along with evidence of the extension.

If the taxes are filed before the actual interview, bring an updated I-864 packet with the updated information to the interview. The CO may request it and having it on-hand can prevent a 221(g) for it afterwards.

So we have to wait till oct before my father can submit the affidavit of support for my sister? thank you.

The petitioner is currently in overseas and he won’t be back to states till september. I’m just helping my father to submit all the required documents for my sister. Thanks for your response Sir.

I wish we could do that Sir so there are no more extra paper work for us in the future. Unfortunately, the petitioner can’t file his taxes due to not present in states. He won’t be back till september. Thanks.

You can file from abroad. Actually, all USCs living abroad are required to file based on their worldwide income (it's even written in his passport).

This is true, you can easily get the extension if you’re abroad but nothing stopping you filing on time (been there done that).

Assuming this long period of being abroad isn’t going to be an issue for domicile of petitioner...
