Hi everyone,

I am wanting to petition for my sister. She is married and has a  4 year old daughter. Do i have to fill out separate I-130 forms for each member? or is it just one for my sister? And is the fee supposed to be paid for one person as well or all three of them? What supporting documents should i submit for the family?

One for her, spouse and children (unmarried under 21) are derivatives on the same petition. Depending where they are from, be aware it will probably take at least 15 years for them to get visas. For now you just submit i130 with proof of relationship to your sister.

Just 1 petition and the fee is $535. Her spouse and daughter are her derivatives. The petition can be filed online: https://www.uscis.gov/i-130 It'll take a long time for the Priority Date to become current: https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin.html Her daughter must remain unmarried until after entering the US with the IV.

India? Could be tight for their child. Currently around 15 years for an F-4 for India but likely to increase. The best you can hope for is a long I-130 approval time to help the child from aging out.

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Oath: March 22, 2021 COVID-style same-day oath

It’s currently taking years to process some i130s for F4 -  8-11 years  at California and Vermont service centers. Should hopefully be ok even for India.

Although USCIS is claiming their new case load has dropped very dramatically and the lack of incoming fees is a big issue. Likely they will either be bailed out and probably process those cases faster (same staff, less cases) or have to cut staff or pause some operations, which may slow things further.

F4 is always going to be last priority though because of the priority dates. Hopefully they concentrate on getting the pile of backlogged N400s cleared!

VJ has a handy guide, think of it this way you as a USC can petition a sibling, any Husband, minor children that she can bring as derivatives only comes up when the visa number is current which will be a long time in the future.

The way the current leadership feels about immigration, I don't think a bailout is anytime in the future, and it would make sense for them to concentrate on all the backlogged petitions, this is the US government, "Makes sense" and US government should not be used in the same sentence. They already have the money for all these unprocessed petitions in the bank, and they are still out of money( so they say). You would think if the money paid for the petitions actually covered the whole cost from filing to completion that they would not have a shortfall of money because they still have many thousands of petitions to still process. I think you are exactly right with the second part of your sentence where you say they have to cut staff ( definitely) or pause/stop some operations, is almost a certainty.
