Hello All,

 

My spouse-sponsored I-485 submission was rejected because it was incomplete; I forgot to tick “’application type” on the form. I’m planning to resubmit but I’m a bit confused. I read other people’s post with similar experiences but I’m still unclear how to proceed. Some say to submit a new package, some I should only fill out what was wrong and resubmit the same package how it was returned. When I resubmit:

  1. Do I need to attach only new I-485 or do I need to reprint all the forms that were in the package, e.g. I-130, I-486, I-944, etc?
  2. If I need to reprint all the forms, do I also need to reprint all the supporting docs, including proof for bona fide marriage, image, passports, birth certificate, utility bills, etc.?  
  3. If I do not need to reprint everything, do I also need to rearrange the docs as I originally sent them, or leave them how USCIS’ reorganized them upon returning them to me?
  4. Do I need to attach new checks or the returned ones with USCIS stamps are still ok?

We had rejection because we used an outdated version of the I-485. I checked with a lawyer, through this forum, what I could have done about the resubmission. He said he had both types of submission for his clients in more than a decade long experience. Resuing whatever USCIS returned, or reprinting everything fresh.

 

I chose to reprint everything, including copies of all proofs - financials, address, identitity etc. I only reused 'Third Party validation' documents, as they were original. It went well. It took me an entire day to print and assemble everything, but it was something I did to follow/copy the original submission package. Also don't forget to put that green letter on the top.

Thanks for sharing your experience! I decided to reuse what they returned. I wrote a new cover letter, and attached a new I-485 with it. I left everything else as it came back in the mail. I will also use the old checks, because they were not processed.

 

I checked the validity of all other forms in the package, and I noticed that I-765 will expire on 5/31/2020. I checked on the USCIS website for a newer version of that form, but it seems this is the most up-to-date version. I just hope now they will receive and process my new package before that date. I plan to resubmit today. Keep your fingers crossed!

I-765 was updated on 4/20/2020, so check the version number to ensure you have the right one. But seems like you are good otherwise. Good luck!
