Hello,

My mother is divorcing my stepfather. Can I petition for him to receive a green card? They married in December 2015 and dated from 2011 I believe.

My stepfather will continue to be a part of my life since he is a great man. He has helped raise my siblings and I and has taken care of every single one of us. They may be divorcing, but they will continue as friends and even though my mom moved out in January I still continue to live with him.
This is very important to me and I believe he deserves it. He did come illegally, but has paid all taxes and runs a small business.

I am 24 years old. My sister is 22, brother 21, and youngest 16 none of us are his kids.

Please advise,
Tarik Miranda

Your sister or younger brother may be able to petition him. Also when you say he came illegally can you be more specific. Did he overstay a visa or was he not inspected at the border?

You can believe he deserves it, however,  the US government might think differently

YMMV

Permanent residency as a family member in the USA is not a reward for being a nice person. It’s granted based on eligibility through relationship. Either your blood or marital relationship qualifies or it doesn’t. In your case, it doesn’t.

People who entered illegally can never adjust status in country. They must leave, sit out their ban, then return with an immigrant visa. Did he enter illegally or overstay after arriving illegally?
