Hello All

Im here in usa under k1 visa. Me and my wife got married 2 weeks ago means within 70 days so does it important to adjust status for AOS within 90 days of we can do it after 90 days too ?

You have fulfilled the terms of your K1 visa as you got married within the 90 days. You may apply for AOS anytime. It does not have to be within 90 days of your entry.

However, please note that you will be out of status on the 91st day after your date of entry. You will revert back to status once your AOS is filed.

If you are out of status for more than 6 months, it is suggested that you no longer file the I-131 (Advance Parole) as you have accumulated enough out of status days to warrant a 3 year bar when you try to re-enter the country even with AP.

Thank you very much eauplain your advice and guidance was really so meaningful to me and indeed i needed to know all that, actually we just have some lil issues which we can fix before my 90 days will be over(which i really hope) so thats why i wanted to know all that, so thanks again for all your help. File for AOS as soon as you can... they're not going to kick you out of the country on day 91, but it gives people a peace of mind to get that first NOA and know that they're (still) legal. If you haven't filed for AOS before your I-94 expires you start accumulating time out of status and too much can be a hassle later on.
