I won’t have to work on this for some time, but I just want to know for the future. I’ve had seriously ill parents for some years now who I’ve been taking care of, and I have very limited work experience and am not currently employed. I will be searching for employment soon (if there is anything available since everything is shut down). I just want to know how much time I will have to provide sufficient proof of income after getting married. Do I provide it after he comes here and applies for adjustment of status? Or is it submitted before he comes to the states? I’m really confused lol.

Have you already submitted the cr1? Because you needed to submit the affadavit of support with that. Do you have 3 years of tax returns to submit? Highly recommend looking for a decent job or finding someone will to be a joint sponsor. This is a serious requirement

No. I had stated above that I am inquiring about this for the future. I have spent many years caring for my parents who are unwell and have a very limited employment history. I just wanted to know the order in which these documents are to be submitted. I do remember being told that if I don’t have tax returns, then a bank statement and letter from an employer would suffice?

The documents are to be submitted at time of submission of the CR1. You would need to explain why you haven't had to file for the last 3 years, your previous 3 month pay stubs and a letter from employer helps- stated you are a full/part time/permanent employee who has been employed since date and you make $ an hour or your salary. Unsure if bank statements are required but I would recommend them. You need to show you make minimum of 125% of the poverty level for your family size in order to sponsor him.

Thank you! So is it doable without the tax returns as long as I submit other proof of income? Do you think a joint sponsor is necessary?

No they’re US citizens. I’m asking about a spouse visa for the not so distant future. The reason I mentioned my parents is because I’ve spent quite a few years caring for them - my mother has battled cancer twice and my father has had ailments on and off for years. As a result, I have never had a steady income because I’ve been at home caring for them. That’s why I’m very concerned about the income requirement. I do not have three years of tax returns to show. But I am starting to look for employment soon and I’m hoping that pay stubs and a letter from employer would be enough.

It is only doable if you will make enough money. Do you or your future spouse have kids? I'm assuming your household will be the size of 2. You need to make a minimum of $22550 assuming you do not live in Alaska or Hawaii. 

 

I pulled the requirement from USCIS site- 

For ALL sponsors: 

  • A copy of your individual Federal income tax return, including W-2s for the most recent tax year, or a statement and/or evidence describing why you were not required to file. Also include a copy of each and every Form 1099, Schedule, and any other evidence of reported income. You may submit this information for the most recent three tax years, pay stubs from the most recent six months, and/or a letter from your employer if you believe any of these items will help you qualify. 

 

If you don't meet this financial requirement you will need to find a joint sponsor.

So if I don’t have information from the most recent three tax years, I can submit six months of pay stubs and other supporting evidence instead?

Oh and one other question! I’m sorry, I’m just a bit anxious about this lol. My father said he would be a joint sponsor if need be and could use his pension. I read online that you could also include income of household members as well? Does this mean that he can use my mother’s income in his total income? I’m not sure I understood that correctly. 
 

Also, if they’re claiming me on their taxes as a dependent now, will that cause issues in the future when I become a sponsor?

That changes everything. If you are a dependent of your parents and there are no other dependants then your household will be 4 and you must meet those guidelines. You need a separate I-864a for Each household member whose income you will use. https://www.uscis.gov/i-864

 

On a separate issue I'm now assuming you are on your parents health insurance or state insurance. You need to show proof that the immigrant will obtain health insurance. If the spouse can't be added to yours you will have to buy it through the marketplace. Costs vary greatly.

If my parents do not claim me as a dependent for this year, or after I become employed, is it still an issue? Or if I end up using their income, is that the same thing as a joint sponsor?

OH maybe I misread what you wrote. If I am a dependent for my parents, do I still need to meet the requirements of a household of 4, or is it just them who would then have a household of 4?
