Hello

I'm planning on apply the CR1 visa for my wife in China.

My taxes were along with my father (I'm accounted as his dependent). However, I'm currently in medical school so my income is zero, so I need my father to become my joint sponsor.

The confusing part is, since we are in same household, does my father need to complete another form of i864 as a joint sponsor? Or can I just add his name under the i864 form that I need to fill out (the section where it says income you are using from any other person who was counted in your household size).

One I-864 from each of you.  Dad is the Joint Sponsor.  If Dad is married filing a joint tax return, then his spouse needs to provide and sign an I-864a whether she/he has any income or not.  Petitioner is always primary sponsor, income or not.

Thanks for responding

Is it possible to go with the other route? Where I have my father just fill out the I-864A form since me and him are in the same household, so there's no need for the "joint sponsor"

No, because you have zero income to combine with him.  Not one of my first few hundred rodeos on this.

okay

So for the part "Income you are using from any other person who was counted in your household size, under part 6 of I-864"

Is it necessary to still include my father's income/info even though he's doing the joint sponsor's route?

Thanks.

No, because he not only is not counted in YOUR household size, but you are not USING income from anybody else in YOUR affidavit.  You're a medical student.  Please become an A-Student of the I-864 instructions and of the instructions on the form itself.  Unless you have children, YOUR household is just you and your spouse, no matter where you live.  If you are still claimed as a dependent on your parent's tax return, you WILL count in THEIR household size, but that doesn't mean they count in yours.
