Need Help In I-864 urgent (merged threads)

Hello All,

I need some guidance regarding I-864

Following are my questions.

i)I am going to sponsor my wife but my income for 2019 is not enough so I will have joint sponsor..... my joint sponser filled his tax return with his wife "Married Filling Jointly" and her wife did not do any job in 2019  so do I have to fill seperatelly I-864A for with Joint sponser wife? or should I write down a letter  for her and get the sign that she did not do work in 2019? and  as all income belongs to her husband which my joint sponser......

ii) As I have joint sponsor Do I have to fill I-864 for myself I am petitioner.

iii)  Tax transcript for 2019 is not available yet I and my joint sponser have sumbitted tax return for 2019 so can we use 1040?

i) Yes - it's the form making sure the spouse is aware of sponsoring. Even if she didn't earn an income, good to have completed.

ii) Yes - you're the main sponsor - no going around that - you have to do I-864

iii) - Yes, you need to include all papers and schedules of 1040 you submitted to IRS.

I have question related to affidavit of support

My current income which is expected (2020)to be 80,000( I have Job letter) and last six months pay stubs but in 2019  I only made 16,000 Because I didn't do work All of the month in 2019...So Do I have to have joint sponsor? to sponsor my wife ......? I am the petitioner

2018- 22,000

Possibly. How many children or dependents do you have? How many people are immigrating? Are you already sponsoring someone else?

So there are three of you: you, your wife and one dependent. With a tax return showing only $16k for a year you are going to struggle, even with your job letter. So your job is completely secure despite COVID-19 and you are still working and making the same money as you were in January and February? Ordinarily, job letters can be used but I would not be surprised if you need a joint sponsor due to the complete economic uncertainty right now. Some embassies are stricter than others. Which embassy are you going through?

I only worked 6 months in 2019.. embassy will by Islamabad Pakistan... In nov I got a good job.... that will make annual salary around 80

Sounds like you have plenty of current income. Note that current income does not mean 2020 income.  If you got a new job last week paying 80k a year, your current income is 80k.  ONE pay stub is sufficient.  Your current income is equal to your gross pay for a full pay period times the number of pay periods in 12 consecutive months.  If you lost your job yesterday, it doesn't matter how much you made last year or already this year, because your "current income" is ZERO.

 

Sounds like you don't need a joint sponsor, unless your spouse is coming from India.  In general practice, you are not required to have qualifying income on your most recent tax return or ANY tax return.  Current income is KING.

Hi,

My all papers have been accepted. Except I-864ez. I have been asked to replace i-864ez with i-864 as I am not qualified to use i-864ex NVC told.

I used my current income to sponsor my wife as it is expected to be $80,000 for 2020, Tax return, Job letter and Last 6 months pay stub were accepted

But my 2019 income was around 16,000 only, because I didn't work for whole year.

So, my question is even I replace i-864ez with i-864 is there any chance that they disqualify/reject I-864 or  on the basis of income .?or should I go with Joint sponsor.(I am not asked for joint sponser by NVC).
