Hello everyone,

We started filling out a petition for alien relative online and have few things that I need to make sure of. I have them listed below. Please feel free to reply back and answer each point you can.

Any advice or recommendations are welcome. Thanks in advance.

 

1) Do I need to include Nexus Pass ID in Travel Document #. I usually use my Nexus card to get in the US.

 

2) Under Visa I selected this:

WT - Temporary Visitor For Pleasure Admitted Without Visa Under The Visa Waiver Program.

Is that right? I don't have any visa in my passport or anything.

 

3) What is the beneficiary's Form I-94 Arrival-Departure Record number? Do I have one?

 

4) What was the beneficiary's date of arrival? Also not sure what to put here. When does the beneficiary's authorized stay expire?

I'm in the US like every week, except during the pandemic, last time we were there was for a day trip and we have not been back since.

 

5) Stupid question but don't see the point of it so I have to ask to make sure there is not a slighly 0.0000001 % change of getting this wrong lol
What is the legal name of your beneficiary's current spouse? I put my Wife's name.

 

6) At which USCIS office will the beneficiary apply for adjustment of status to lawful permanent resident? Left this blank

 

7) At which U.S. Embassy or Consulate location will the beneficiary apply for an immigrant visa?
Montreal Quebec Canada?

 

😎 Evidence, We'be been together since 2012, married end of 2018, started living in Canada. Now we're looking to relocate because my wife works in the health field and already licensed in her home state and is ready to practice. We have a lof pictures to include, since 2012, you can see us age in these pictures. Also attaching our childs birth certificate, drug and dental coverage plan that list the three of us as family. Bank statement showing joint accounts and credit cards. Do I really need more evidence? and would have to get an affadavit ?

 

9) marriage certificate did not fit in the scanner, scanned it twice to show full document, is that fine?

 

10) How do I attach pictures ? I scanned it but it's Letter Page and has all that white gap, do I need to take that out?

11) 130A filled out electronically and will submit it electronically.

 

12) How do we sign up for text notifications

 

13) We're filing online, what is the USCIS account #?

 

16) Should I sign up for USCIS account and include it? What's the benefit?

You can get the I-94 Arrival Departure number on the link provided in the I-130 directions here! I was able to get the information from my husbands visit to the USA on the 90 day Visa Waivor program.

Kind of a lot of questions all at one time.  You don't need an I-94 unless you are IN the USA on the date the petition is filed.  No, your nexus pass is not needed as a document number.  Just the passport number.  Montreal, yes.  Arrival date and stay expiration also only apply if you are CURRENTLY in the US at the time of filing.

Facts are cheap...knowing how to use them is precious...

Thank you for your help. Maybe that's why I'm not getting responses, a lot of questions like you said.

Just adding that you can use a different scanner for that marriage certificate, one that will fit the whole page.  I would not use two separate scans.

I used Genius Scan app in our phone to get a whole one picture of it but it doesn't look like it came out of a scanner, it looks like it was drawn.

 

Any idea about the 2x2 pics we're supposed to submit?

Use a real scanner.  What is your question about the pics?  Follow the instructions.  Are you submitting online or by paper?  Please don't try to do all this with a phone.  You will find many limitations.  I actually recommend filing on paper using Priority Mail.

Filing online.

There shouldn't be any difference. We would submit by mail but don't think the wife wants to go to Michigan and send it, I can't cross myself I think, I don't have a visa or anything. So we're filing online for convenience.

 

For the 2x2 picture, we're using a printer/scanner (not using a phone) but the pictures are coming on on a letter sized picture. With a lot of white space and the picture is in the top corner of the paper.

But there IS a difference.  He does not have to GO ANYWHERE to file the petition.  Just mail it or send it by courier from wherever he is.  There are instructions for the photos.  Follow the instructions, or if filing by mail, just include his passport photo.  One is not needed for you, the foreign spouse.

 

There are still issues with the online filing process and no real advantage to it, in my opinion.  Not my first rodeo or first few hundred.

Hmm, ok. Didn't know there was issues with online filing.

Is it a lot more work to file using paper?

We have the application all filled out online.

So if we fill out paper application, we can send the package from Canada using a courier ?

Of course, but if not delivered by US Postal Service, use the alternate address instead of the PO box.  That you thought otherwise is really concerning with regard to your ability to read, understand and follow instructions.

 

No, it's not a lot more work to file on paper.  Use a printer.  Address and envelope.  Pay the fee or postage.  Nothing about this is going to seem "easy" to you.  What's important is to do it correctly.  No shortcuts.  No "easy way".

Didn't read the instructions about sending it by mail, if I do end up going that route, I'll read the instructions at least twice to make sure I'm doing everything right. 

We've been doing the online version of the I130 and the application is straight forward to work on. 

 

I'm curious tho to what problem people have been facing with online filing? There's a thread on here with 29 pages, I'm gonna have to read it all. 

You're right about the easy part. Do it right and correct is what matters.
