Hi, 

 

My fiancee and I had the K1 Visa approved in Madrid but she will not be able to enter the United States before it expires due to the travel ban, immigration issues and pandemic we are currently facing. I was wondering if it was possible to transfer her case and/or receive a reissuance of this visa from a different Embassy. She is from Mexico and has been in Madrid on full lockdown for a long time now and would like to be with her family in Mexico. We are just not sure if this is possible and/or if this will hurt her chances of receiving a reissuance.

If she is still a Mexican National that shouldn't be a problem.  Unfortunately Juarez tends to be slow.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

As previously mentioned, she is all alone in a small apartment in Madrid. Hasnt been home in almost two years and hasnt seen her family since September. We are just curious as to if its possible. A reissuance might take months as well - we have no idea when the Presidential Proclamation 9993 will be lifted

and we also have no idea when the border here will be lifted 

any European country is better off than Mexico (just my opinion, of course) but the administration has been talking of a wall between these 2 countries now for over 6 years (during his campaign and in office)

an approved visa will get a renewal 

just think when she comes ,  she will also be alone while you work and she is stuck quite a while till she has permit to travel

this is hard ,  we all know but to give up an approved visa and try to get it reissued in Mexico is scary

Yes, I agree. We shall see and hope all of this gets settled in the next couple of weeks.

Does the travel and work permit get issued separately? How long do these normally take? 6-8 months?

Better answered from those who went thru the process as i did not have to do this /  i was IR1

She can go back and be around family for now.  If she does get the K1 in Mexico she can fly from there (still not allowed to land cross).   Pre covid19 we had Filipino / American married friends that were approved by NVC and then decided to interview in Manila where there was no wait.

 

If the consulate in Spain re-opens first she could potentially redo there.   Mexico is an inconsistent mess - I can't go to our house in Sonora, but I can go to our office in Baja - Don;t get me started.

 

Pre covid19 AP/EAD was taking 4 to 6 months.   They can be issued separately but usually together when submitted that way.

Plus added time needed to transfer her file from Spain to Mexico
