Only the petitioner has to prove income. They do not care how much money the beneficiary makes. Whoever is the Sponsor must supply the proof of income only.

i want to ask about do my wife should include her recent PAY STUBS with I-864 or not ?

I am assuming that your wife is the petitioner. If that is the case, I think that recent pay stubs should be included with I864. They are not required but I would rather have too much information than too little information.

FORM I-130 PROCESS

Jan. 15, 2007 - Got married in India

Feb. 02, 2007 - Sent Form I-130 via Certified mail

Feb. 05, 2007 - NSC Receives Form I-130

Feb 07, 2007 - NOA-1

Mar. 15, 2007 - Touched

April. 11, 2007 - Touched

April 17, 2007- Approved!!

May 01, 2007- Touched

NVC Processing of I-130

April 27, 2007- Received by NVC

May 14, 2007- IV Bill and AOS fee bill Generated

May 22, 2007- Sent AOS fee bill

May 27, 2007- Received AOS fee bill in mail

June 11, 2007- Received I-864 package in mail

June 14, 2007- Still no IV bill. Called NVC so that they can resend it.

June 18, 2007- Sent completed I-864 package

June 22, 2007- Still no IV bill

June 25, 2007- Finally Received and Paid the IV bill!!

August 05, 2007- Sent DS-230

August 21, 2007- Case Completed at NVC

August 27, 2007- Case Forwarded to Embassy

October 15, 2007- Interview!! Visa approved!!

October 18, 2007- Visa in hand

October 27, 2007- US arrival!!

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

send pay stubs. I got RFE'd because I didn't send them. I sent a 6 month contract instead which you'd think is better proof of current employment than a monthly paystub but apparently it wasn't good enough.

summer fling failed to fizzle, married 2003

I-130 mailed 12/15/03

4/1/04 no word from NE contacted senators office, app found

NOA1 4/13/04

Gave up on ridiculously long US process-started Canadian

12/4/04 submitted app

LSS app returned because of missed signatures, lost in transit, resubmitted in June

9/28/05 landed, yippie

10/4/05 fly back to US to "finish up Master's" lose mind and switch to PhD

Damn it back to the US process

3/something/2005 finally get NOA2, no idea why it took so long

4/15/07 get case approval from NVC

8/9/07 Montreal here we come

10/14/07 hubby activated his visa

Well, I can see that with just a contract letter they can assume that it could be a fake. With pay stubs you can tell how much you make with taxes and all.

And I agree, the petitioner should send recent pay stubs just to be sure, even though they're optional.

The instructions say that pay stubs are optional.

People who have not provided pay stubs have received RFEs asking for pay stubs.

In summary - pay stubs are optional until specifically asked for, then they become necessary.

I've been following Hanout's posts about his wife's income, so his questions about "required" concern me.

Hanout, your wife must offer supporting documentation to prove the stated current income is correct. Since her 2006 income is not sufficient, the only way she can qualify as the sole sponsor is if an annualization of her current income is sufficient. The only practical evidence she can offer is pay stubs. So, in your case, the pay stubs are going to be required, even though they may be optional for others.

Facts are cheap...knowing how to use them is precious...

Yes, I have been reading Hanout's posts and replying them as well. This is what Hanout needs to do:

Have his wife (the US Citizen petitioner) get a co sponsor and have his wife send her pay stubs with the I-864 packet.

I suspect they didn't accept the contract because it doesn't confirm you are actually employed. The pay stubs do.
