Hi there,

 

I have submitted my joint sponsor’s I864, proof of US domicile, proof of citizenship, 2019 income tax return doc, proof

of job letter and income tax return transcripts of last 2 years. Now I have noticed that the proof of relationship letter between Joint sponsor and petitioner is missing, I’ve acquired and submitted it. I’ve asked my joint sponsor to provide me with his latest w-2 but he said he doesn’t have it and rather suggested me to submit the first page of form 1040.

However, my question is after submitting all of the above mentioned documents is it still necessary to submit joint sponsor’s W-2 form????

 

would be really helpful if someone provides feedback on this!

For the tax return requirement of the I-864, you need to provide either a tax transcript or a full copy of the return.

If providing the copy of a return, you need the 1040 + all W-2s, 1099s, etc. Basically all forms and supporting evidence of income used for it.

The 1040 alone could be just a form they filled out with whatever numbers they wanted on it. I could print one right now and put that I earned $1,000,000 last year, but I would have never submitted it to the IRS and have no evidence to support that number.

thank you for your quick response to the inquiry. 
Please note that, I’ve asked my joint sponsor to provide me his W-2 for 2019, but he said he didn’t kept it after he filed his tax. Now if he wants another w-2 he would need a 2-3 months time period to get another w-2 from the IRS as it cannot be acquired electronically. 
 

In this circumstance would it be appropriate to submit documents except the w-2

 

My first submission of documents was at 25th February and I’ve already wasted a lot of time in between.

Can he get an IRS tax return transcript electronically? That would be the simplest option as it includes everything needed.

Quote

You must provide either an Internal Revenue Service (IRS) transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year.

...

If you provide a photocopy of your Federal individual income tax returns, you must include a copy of each and every Form W-2 and Form 1099 that relates to your returns. Do not include copies of these forms if you provide an IRS transcript of your Federal individual income tax returns rather than a photocopy unless you filed a joint income tax return with your spouse and are qualifying using only your income.

So if he filed jointly and wants only his income counted, he needs the W-2. If he did not filed jointly with a spouse, they are not required.

(Note this if he did file jointly, they often want an I-864A from the spouse anyway)

You do not need W2 if you obtain a return transcript from the IRS.

- Proof of US domicile

- Federal Income Tax Return 2019

- Proof of current self employment

- Federal Income Tax Return Transcripts 2018

- Federal Income Tax Return Transcripts 2017

- Proof of relationship between JS and household member (submitted today few hours ago)

 

The only document missing here is the W-2 form, I asked my js to provide W-2 he said he hasn’t kept it after filing tax return.

 

However after submitting all the above mentioned documents, the document bar on the top right corner is still white which may mean that documents isn’t still fulfilled and when I click on it, it takes me to the js page immediately.

 

I feel like I am in big mess and it’s breaking me over and over.

I understand your frustration, NVC can be very stressful but you will get through it. Just have to stay positive. 

Have you submitted a completed, signed, and dated I-864 form, tax information of petitioner and employment letter of the petitioner?

Did you click on  add joint  sponsor tab after uploading petitioner's doc? If yes,  did you check under ceac account if it says “submitted”

Hello Kendelle,

 

yes I have checked and cross checked everything you mentioned. However through the nvc website I found out the latest check list for affidavit of support, and found out that I haven’t submitted the w-2 of the joint sponsor, which is a must do according to nvc new rules imposed on 07/31/2020. Therefore I think submitting the w2 would eventually result in fulfillment of all documents and the document section on the top right corner (when you login to CEAC) would turn to red from white. 
By the way, as I’ve mentioned earlier that my js hasn’t provided me with his w2 and saying that it may take time, therefore I’ve decided that I would submit his IRS latest transcript with last 4 weeks pay stub attached in the W-2 document type. I hope this work. Still waiting for the JS response, I hope and pray that something positive comes out of it ASAP.

If you were able to obtain 2019 transcript from IRS then you do not need W-2.  If you do not have the transcript and you have 2017, 2018 transcript with sufficient income, then do not submit 2019. You can still use 2018 as the most recent tax year since the filing deadline for tax returns has been extended from April 15 to July 15 this year.  If for whatever reason you want to use 2019 as the most recent year instead, then yes, you can do so.Both are valid options.  I did not submit 2019 as the most recent year, I used 2018 transcript and got DQ.
 

Keep in mind if you submit 2018 tax information as the most recent year and your interview is scheduled after July 15th, which is the deadline, then 2019 tax transcript will likely be required at the interview.

Hi Kendelle

 

I have contacted my joint sponsor, he said he will be providing his IRS transcript and last 2 pay stub shortly. However He also added he will be providing his w2 as well if he finds it. Lets just hope that he provides his w2 and after submitting w2 I can fulfil the documents required to make my case eligible for review. 

 

As you can see in the attachment the green marked "DOCUMENT" section is still white and not RED as like as FEES and IV APPLICATION. I believe that it is still white because when I click on it, it takes me directly to the Joint Sponsor page. I hope after submitting W2 of Joint Sponsor this GREEN MARKED DOCUMENT section will also turn to red. I have other relatives who has submitted all the documents as like as us except the fact that we haven't submitted the w2 of JS, their documents  section is RED and ours is white which clearly indicates we have a document missing for which is W2 of JS.
