Hi! Im traveling late November for Italy because my husband's in the Navy so I should come with him because I'm his dependent. He has his orders already and we should stay there for 3 years. We just got married last May and still in the process of filing AOS. Hopefully I could get my GC after 3 mos without any delays and RFE's.

My questions are,

1.) can I come with him and stay in Italy with my temp green card only?

2.) should I do some paper works also? What else should I do and how do I do it?

3.) Would I be still entitled for Removal of Conditions after 2 years of my GC's expiration date with me living outside US on that period?

I would be entering Italy with a "No-Fee Passport" which will be provided by the Military, so no problem with that, my concern would most likely focus on how can I go back to US after my husband's duty and get a renewed Green Card afterwards.

I hope you guys can help me with whatever knowldge you have, even in the littlest way I would very much appreciate it. Thanks!

I don't know if USCIS will consider you've abaondoned your green card or not, or if they will consider you still living on US soil if you are on a US base in a foreign country. If they deem that you've abandoned your green card, you'll have to reapply while you're still in Italy before your husband gets sent back home.

The base lawyer may have more information.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card

PLEASE DO NOT PRIVATE MESSAGE ME OR EMAIL ME. I HAVE NO IDEA ABOUT CURRENT US IMMIGRATION PROCEDURES!!!!!

We'd try our best to get an apartment on base housing. It's really tough to file for everything regarding my immigration stuff, plus the paperworks to my military stuff.

It's a handful of paperwork actually. It never stops.

I've been researching and posting, calling people, but you can't get answers on just one sitting.

Thanks you so much Reba ill also try the base lawyers

There was someone the other day asking a similar question about leaving the USA with the military, and someone answered, saying that living on a US military station outside the states is counted as living on US soil. Good luck.

Hi! Thanks for your answer, I'm so relieved. What I would do next is to find some infos regarding paper works on preparing for our transfer.

Thanks Meriem_setif!

When the time comes for the removal of conditions, - still 2-yr minus 90 days timeline for that, you will also want to submit copy of orders showing you were with him on deployment as dependant.

I'm sure you have yor military card already - you can always go to the family center and they can help with a lot of things, this one included.

Best of luck,

meli
