do I need to produce "Additional proof of marriage" (e.g. Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship; Documentation showing that you and your spouse have combined your financial resources.. etc).

In that section you can upload very few (if any) files since your marriage is recent. Or you can include a few things from your dating time. In your case, that is why conditional 2-year Green Card exists. About 2 years after US entry you'll do Removal of Conditions and present commingling, etc. documents.

Thank you for your response. Do we need to have joint bank accounts or third party sworn affidavits?

It would be great if you have evidence of commingled finances like joint bank accounts, but it is not expected from couples who live in different countries.  You may upload third-party affidavits, but be aware that these are weak evidence because anybody could swear to anything in an affidavit.

I strongly recommend you upload evidence of time spent together in person, including those from before you were married.  Examples:

  • Passport stamps, boarding passes, hotel receipts, your fiancee's I-94 travel history
  • Pictures together from different times throughout your relationship.  Include photos at tourist spots and photos with family and friends.

Is it ok to file the petition while my wife is still with me in the US? She will return in the Philippines this Feb, or when the travel restrictions are lifted. Thanks!

Yes, you can file now. Reminder that she'll need to sign the I-130A spouse supplement and then you upload it in the appropriate section.

I saw this thread a little late, but since your wife is still in the US, do look into setting up joint bank accounts or adding her as an authorized user to one of your credit cards. It'll add to your evidence of a bonafide marriage and also help your wife build a credit score, in preparation for her eventual permanent relocation to the States. Good luck!

On this section, do I need to indicate the days while she was with me in the US (on a tourist visa) or do I put "Never Lived Together"?

We put "Never lived together -- Only visits".

Thank you for your suggestion. We actually went to the bank but we are not able to open a joint account since the bank requires her to have a social security number. Instead, I was able to add her on my bank account as "ITF or In Trust For". Hope that will work.

  • 2 months later...

Hi all! We have received our welcome letter from NVC and we are now gathering the required civil documents. My wife's passport is expiring in August this year. She have scheduled an appointment to renew her passport this month, but given the current quarantine restrictions in Manila, this might get postponed. Can we input her current passport details on DS-260 and upload it as well?

Yes, enter her current passport details.  On the day of her interview, update the passport details on the DS-260 at the embassy.
